With global warming,air pollution,fossil and other non renewable energy is reduced,the world more and more attention to sustainable development,green development and utilization of renewable energy to be like wu.Solar energy as an inexhaustible green energy,its use technology-photovoltaic power generation technology is very mature,which makes countries for domestic better sustainable development and competing in domestic promotion of photovoltaic power generation.China’s photovoltaic power generation as the bright younger generation,after years of development,cumulative PV installed capacity and annual new installed capacity ranks first in the world,the domestic photovoltaic power generation has gradually formed the eastern and Western joint development,the pattern of centralized and distributed.In addition,photovoltaic power generation can also be integrated with agriculture,fishery,forestry and other industries to develop together.At present,China’s photovoltaic manufacturing industry to continuously improve the level of photovoltaic power generation technology innovation accelerate,component costs and prices continue to decline,the photovoltaic industry policy system gradually established,all of which makes our country have a large-scale promotion of photovoltaic power generation conditions,only the legal system is in want of perfection to promote photovoltaic power generation is not perfect,there are many legal and practical photovoltaic development needs not suited to the situation,restricting the popularization of photovoltaic power generation in our country,urgent.Through the method of literature review and investigation finds out the legal factors,the promotion of photovoltaic power generation is the following aspects:administrative approval,construction land and roof leasing,power grid enterprises do not fulfill their legal obligations,the establishment of market order grid perfect supporting facilities,funding support and security problems.And with the help of "forest light complementary legal problems caused by project and the lease agreement photovoltaic two legal case analysis,analyzes the current legal factors limit the popularization of photovoltaic power generation.With Germany,the United States and Japan to promote photovoltaic power generation related legislation and policy experience,the use of photovoltaic power generation in our country "13th Five-Year" planning,the new photovoltaic project,the domestic photovoltaic power generation terms in current law and other practical content,puts forward corresponding suggestions in legislation.Specifically:photovoltaic project administrative approval law suggestions,photovoltaic project construction land leasing law and roof suggestions on compulsory enterprises must fulfill their legal obligations,for suggestions to improve the photovoltaic market order law,promote photovoltaic power generation project funds sufficient protection legal advice.The author intends to use Germany,US and Japan,the popularity of photovoltaic power generation in command and control,economic incentive,create market type three legislative model to make relevant legislation of China’s photovoltaic power generation system,and adapt to the development of China’s photovoltaic power generation,forming a set of China characteristics of photovoltaic power law in order to solve the photovoltaic power generation system,the promotion of legal constraints.
