With the unceasingly deepen reform in financial system, the private banks become one hot topic, and has initiated many arguments in academic circle's. Some scholars thought that private banks represent the direction of our country's financial reform, and pointed out that the private banks has superiority in many aspects comparing to other types banks, especially the state-owned banks, so they advocated to develop the private banks vigorously. Also some scholars believe that if some necessary mechanism has not established, the private banks will face great risks. The quantity of the existing banks has been able to meet with our needs, and it can achieve the goal of our reform.On the basis of reviewing the history of our financial reform, referring to massive materials, catching on the theory of property rights and other relating thought to analysis private banks, this article thinks that the superiority of property right is the most basic superiority, and it brings other superiority. It introduces the main performance of this superiority: the property rights is clear, managing rights is clearly limited, disposed rights can be realized, the income rights are safeguarded.Then it uses the request - proxy theory, the property right and cost of exchange theory, rent-seeking theory to explain the superiority property right. It unifies the reality of China Minsheng Banking corp to elaborate the performance and effect of superiority of property rights. At last, this paper analyzes the present situation of the state-owned 1 bank, the joint stock commercial bank and the city commercial bank and wants to enlighten their reform.
