On The Construction Of The Network Monitoring System

For the human society, Internet is a twinkling double-blade sword. With the rapid development of network technology, global information sharing comes true. Meanwhile, adverse effect also comes along it. Openness of Internet is a great advantage for network development, but also contains uncontrollable risks. On the other hand, the virtual network world makes network face a great number of uncertain objects, and thus network management faces uncontrollable potential threats.Network supervision is a necessary and effective management means to ensure that network develops towards a normal and healthy direction. However, since Internet's development history is not long, especially in China, network development is not very mature and perfect in China. Accordingly, China's network management system and legal system establishment is just in the initial stage. In this instance, various kinds of network-related cases occur frequently every year in China, and trend to be doubled year by year, causing numerous losses to normal development of network and social progress. It is urgent to establish network supervision system; otherwise, China's Internet industry cannot develop normally and healthily.China's existing Internet management mode played an important role in the initial stage of network development. However, with the rapid scientific and technological advancement, Internet development changes quickly. The network management mode, which regards administrative laws and regulations and bylaws as the main basis and administrative means as the main management way, has lagged behind the need of network development apparently. So far, China has not constituted a network law that is fit for the need of network development except a para-legal instrument on network supervision, i.e. Decision on Maintaining Internet Safety promulgated by the Standing Committee of the National People's Congress. Even so, its legal provisions on network management, especially on network supervision, are incomplete and even do not meet the need of network development.Network supervision system establishment is the only way for network development. Currently, it is an important task for China to constitute a network supervision law which meets not only the need of network development but also the need of social development. Through analyzing China's present network development situations and combining the need of network development and actual social problems on network supervision, this paper reconsiders and analyzes China's network law constitution, especially network supervision system establishment, and provides some useful legislation discussions for lawful network management and construction. It is of great practical significance for constitution of China's network laws.
