Soil pollution prevention and control is globally being concerned by states and public, it also is a researching focal point of law scholars. Many scientific achievements and facts show that soil pollution would lead to big environmental disasters. Right now, soil pollution is a very serious problem in our country, and it is more complicated than water pollution, air pollution and other waste pollutions. But the actions of making laws to protect soil has not been done in our country, there are many things need we do.This thesis pays close attentions to build the law system of soil pollution prevention and control, at the same time, the thesis analyzed the significance, causes, contents of law system which need be built and other things of soil pollution prevention and control from many aspects. The target of thesis is to build the system of soil prevention and control, and show some viewpoints.At the process of analysis and demonstration significance of soil pollution prevention and control, the thesis introduced the soil conditions, the relationships between globe warming and biodiversity and soil pollution. The focal points of analysis are functions of soil in ecology system and the relationships between human being's existing and development and soil pollution. The author thought that peoples must protect soil to keep the healthy development of ecology system. So it is very important to legislate for soil pollution prevention and control.At the process of analysis and demonstration causes of soil pollution and control, the thesis introduced the causes of soil pollution from originating and categories. The author thought that the most important feature of soil pollution is indirect in many ways, so we could get a result that soil pollution were mostly lead by other pollutions, such as water pollution, air pollution and so on. It gives us a train of thought to build law system of soil pollution and control. At the same time, according to the features of soil pollution, the author thought that to prevent and control soil pollution in a large scale in our country are very difficult, but it also is possible to do. The key point to resolve those problems is to develop advanced technologies. Following, the thesis introduced the conditions of law of our country, which is about soil pollution prevention and control; the author found that there are many defects. Facing so serious problems, the author suggested that our country must make soil pollution prevention and control law and build law system of it as quickly as we can. At this part, the thesis introduced experiences of America and Germany in soil pollution prevention and control. The author thought that the key points to prevent and control soil pollution are to clarify responsibilities of soil pollution and take measures. The advanced experiences of America and Germany give us many inspirations; we could study those experiences when we build the law system of soil pollution prevention and control.At the process of building government administration system of soil pollution prevention and control, the author thought that government should lead it. According to analysis on conditions of government administration system of our country in soil pollution prevention and control, we could find that there are many defects, so the author suggested reforming our country's government administration system and giving himself opinions. For examples: based on different soil regions, dividing different government administration scopes; reforming the government administration authorities; reducing government administration levels, and building reasonable government administration system.At the process of building law system of soil pollution prevention and control, the thesis analyzed and demonstrated eight regimes to build the law system. They are the survey on conditions of soil pollution regime, the soil pollution supervising and forewarning regime, the soil pollution region register regime, the soil pollution environmental impaction assessment regime, the soil pollution environmental responsibility insurance regime, the soil pollution control regime and so on. This part is the core of the thesis and it is detailed to describe the regimes, including the main contents of regimes and how to do it in concrete practices.At the end of the thesis, the author gave some suggestions which is about legislation, such as to make soil pollution prevention and control law, to build complete law system of soil pollution prevention and control; and some other opinions like establishing soil pollution prevention and control market, promoting the development of soil pollution prevention and control science technology, increasing public's aware on soil pollution prevention and control, and so on.
