Research On Soil Pollution Prevention Fund System

As a government fund,the soil pollution prevention and control fund refers to the reserve funds according to certain procedures and standards,when the person responsible for site pollution is unknown or the responsible person can not fully assume liability,the fund shall provide funds for the restoration of the soil ecological environment of the contaminated site.The Law on the Prevention and Control of Soil Pollution,which came into effect on January 1,2019,clearly proposed the establishment of a soil pollution prevention and control fund system,which was a highlight of the law,but the current law only uses one or three provisions to provide principles for the content of the soil pollution prevention and control fund,and does not specify the source of funding for the soil pollution prevention and control fund.Specific issues such as the establishment of modalities and operational management do not establish a complete specific institutional framework.On February 27,2020,the Ministry of Finance and other six departments jointly issued the Measures for the Management of the Soil Pollution Prevention and Control Fund,which put forward the need to standardize the collection,management and use of funds,and to do a good job in the internal control and external supervision of the Fund,while improving the risk restraint mechanism and preventing operational risks.However,there are still no specific methods for specific sources of funds,management mode,operation supervision and responsibility setting.Based on the legal analysis of the system of the soil pollution prevention and control fund,this paper tries to make clear the specific contents of the soil pollution prevention and control fund system in China from the establishment principle,the source of funds,the establishment of responsibility,the management and operation.
