This thesis takes Shandong as an example, gives an systemic description analysis and summarized on the issue of rural land contractual management right,explores the factors influencing rural land contractual management right circulation. The paper puts forward the land policy recommendations of circulating market,in the hope of offering scientific basis for improving rural land contractual management right and circulating system.Investigated data analysis reveals that, the circulating range of rural land contractual management right in Shandong circulates is expanding constantly, the circulation pace is being accelerated too, but it has form no regular procedure of circulating. Rural land contractual management right circulating occurs only between household and neighbor or relatives, with fewer contracts but often verbal contract. The form in which the right of land contract circulates is mainly subcontracted of land, and there is not prominent difference in developed area and underdeveloped area.Investigations indicates that the mode of rural land contractual management right circulation shows variously, mainly includes the pattern of'Share and Cooperate', tangible circulating market, corporation combined with village organization and rural household, corporation combined with cooperation and rural household, and the form of'rural household plus household'. These patterns which rural land circulating relies on have enormously improve rural household income; promote the rural laborer to shift, the circulation become more orderly, attract social capital to participate in the agricultural appropriate scale-operating and rural infrastructure-building. Meanwhile the rural working condition is obviously improved.The survey showed that the problems of the rural land contractual management right circulation in Shandong are as follows: First, the scale of rural land contractual management right circulation is narrow, as a result of inadequate land supply and demand; Second, the rural land contractual management right circulation is disorder, because the circulation is Spontaneous and decentralized, and most lands are circulated privately with a"verbal agreement", and lack of effective guidance and norms. Third, though spontaneous and scattered land circulation has the universality of application in rural areas in China, as a result of the narrow scale, the problem of Scale operations can not be fundamentally solved; Fourth, It is lack of rural land price evaluation system, and the spatial distribution of information about supply and demand is widely dispersed, means of information delivery is backward, development of intermediary organizations is imperfect, so the maturity of the circulation market is immature.Analysis shows that, China's current land system has a range of defects, and it can not meet the demand of market-oriented of the rural land contractual management right circulation; Beside the function of income and employment, land has the function of social security, and this restrict the rural land contractual management right circulation; The level of economic development, as well as the proportion of non-agricultural employment is the main factors affecting the rural land contractual management right circulation, cultural characteristics of communities also affects the way land and scope of circulation; Family income levels as well as the head of the household's age and number of years of education for farmers is the land contractual decision-making factorAfter analyzing on current situation of rural land circulation and influencing factor in Shandong. the paper argue that setting up and amplifying land contractual management right circulating market is an effective way to promote rural land circulation and optimize rural land resource distribution. It will be significant to identify the key element of circulating market, system structure and operation rule. Peasants' subject status must be protected in rural land circulating; roles of the government should be changed meanwhile. During rural land circulating, we should obey the principle of not changing the relationship of land usage and the contract itself, and follow the market price and land supervision principle. Setting up land price assess mechanism, system of land circulating intermediary service and dispute adjustment system can be another important issue. Meanwhile, we need to improve land property institutions and strengthen the rural constructor of social security, and then create a good institutional environment for the circulating of rural land contractual management right.
