Research On Law Issues Of Public-property Supply In Rural Areas

The public goods of rural area is an important component of the entire social public goods. Whether they can be efficiently provided is a big problem which matters the rural areas and peasants of our country. For a long time, due to the binary economic structure of our country as well as two different supplying system between rural area and city, the historical debt and insufficient supply of rural area becomes more and more serious. Originally, the tax and fee reform in rural areas can efficiently solve the problems of illegal extra fares, unjustified financial levies and arbitrary expenditures in the supply of rural public goods. However, because the tax and fee reform in rural areas does not proceed with the reform of public goods supplying system, it could possibly worsen the financial condition of the local government to a certain extent and thus further influence the quantity and structure optimization of the public goods supplying system. Besides, in the supplying process of public goods in rural areas, it still exists various problems such as the unicity of supply entity, the"top-down"decision mechanism and the insufficiency of financial support, which cause the shortage of public goods supply in rural areas, the imbalance of structure, the low efficiency and illegal extra supply. Therefore, based on the deep thought and research on the legal issues of the public goods supplying system in rural ares, this paper proposes relative legal safeguard measures. Through constructing complete legal systems of rural public goods supply, and exerting the adjustment function of law to society, the rural public goods supply can proceed smoothly, which can further contribute to the development of agriculture and rural areas, increase of peasants'income, as well as the the stability and development of the whole society.This paper falls into five chapters. The first chapter states the concept, characteristic, function and history of rural public goods. The second chapter is a theoretical analysis of rural public goods supply, whose theoretic foundation are economic adjustment law and public goods law, which also compose the theoretical basis of this paper. The third chapter analyzes the legal problems existing in the rural public goods supply system. The fourth chapter analyzes the cause of these legal problems proposed in the third chapter. Based on the present condition of rural pubilc goods supply in our country, through reference to relative foreign legislative experiences, chapter five expects to give some innovative idea to perfect the legal system of rural public goods supply in our country.
