The Legal Research Of The Territorial Planning

For the economical sustainable growth,the key lies with the effective use of land resources with the absence of land resources. Through unlimited possession of the resources realizing economical growth, the way has aroused our watchfulness, which has been leading to the resources destruction and waste. And sustainable development not only is a economic problem but a legal matter.As China is now in the accelerating process of industrialization and urbanization, the problems between resources, environment and development have become outstanding and prominent. Land use planning, as a significant macro-regulation means, has played an important role in harmonizing the relationship between the mankind and land resource. Under this background, China has initiated the third round of amending the comprehensive land use planning. The scientific study and evaluation to the land use planning's implementation will be beneficial to constituting and implementing the new over all and use planning, so the land use planning can turn into a virtuous cycle.This paper is composed of four parts. The first part reviewed and summarized the related studies of Territorial Planning both home and abroad. In the second part, the effects of Territorial Planning and its operation mechanism are introduced. And in the third part, Territorial Planning legislative are reviewed and evaluated. In the last part,we propose to the relevant opinions of the perfect for our building of the Territorial Planning legal system:First, from the legislation to improve, and establish the land use planning system to adapt to the new situation; second,it is necessary to formulate a reasonable Territorial Planning framework and objectives, and properly handle the relationship between overall planning of land use and urban planning and other professional planning ; third,Territorial Planning should be more concerned about human needs, stressed people-centered concept.Practice continues its development, and recently, China began a third round of the national land-use planning framework revision, the author will also pay close attention to the work of our land planning process, and in accordance with the new situation in a timely manner to amend his own mistakes.
