A Study On The Protection Of The Rights Of Peasants

Since reformation and opening in China, a great deal of farmers land has been expropriated by government in the process of urbanization and industrialization. As a result, the land-lost peasants come into being. Although the government strictly controls the land use for construction, the amount of land to be requisited and landless farmers will go up for sure taking into account of the speed of industrialization and urbanization. Due to historic and realistic reasons, the landless farmers in China lack proper support of social security. The landless farmers often become farmers with"3 Nos"—i.e. "no farm land, no jobs and no minimum social security". They tend to have difficulties with basic living and are dissatisfied with the society. The land is of big importance to peasants. It acts as the double roles of means of the production and living guarantee in peasants' life all the time. So land-lost peasants face a series of problems such as living, employment and social security. If these problems are dealt with improperly, it is very apt to cause the social contradiction, and influence the stability and harmony of urbanization.This paper gets the basic conclusion from the brief introduction of urbanization theory, the theory of social justice, the Marxist land-rent, land price theory and social security theory. We analyze the main problems of landless peasants in the process of China's urbanization. In defining the rights and interests of the farmers, described the damages to the interests of landless peasants through the process of urbanization, underlined the importance of the protection of the rights of landless peasants through the urbanization process. Then we introduce the Shanghai's "Town Security Mode" Pattern and the social insurance model of Jiangsu, Zhejiang. Through a comprehensive analysis and comparison of China's social security system features in the transition period we sum up the conclusion that the social security system for land-lost peasants is not only different from that of rural residents also different from the social security system for urban workers. Then the paper mainly proposes the construction of the basic framework for landless farmers' social security system and some suggestions. Analyzing from the dual urban and rural social structure, the existing land requisition compensation system, landless peasants' social security system, the functions of the rural grass-roots organizations perspective, the paper give the reasons of the damage to the rights of landless peasants. At last the paper put forward some recommendations for the protection of the rights of landless peasants. We hope the disquisition and innovation could be helpful to advance the practice of the protection of the rights and interests for peasants.
