Research On The Rights Of The Lost-Land Peasants

With the process of urbanization and industrialization advancing more and more rapidly, peasants' collective land have been expropriated a lot and therefore a new group of weak people comes into being , which is called land-lost peasants. Moreover, the number is enlarging promptly. At the same time, peasants' rights and interests are being damaged along with the lost land. If the problems are not dealt with suitably, it would cause social disputes affecting the social and economic stabilization. A great many experts and governments pay high attention to this problem. How to help the lost-land peasants settle down properly is one of the most urgent problems for our party and government.Based on the urbanism theory, renting-land theory , and the social security theory, my discourse deeply sets forth the current situation of lost-land peasants' damaged rights and analyzes the causes in details by the means of qualitative and quantitative analysis, evidential analysis and standard analysis. The main causes affecting the lost-land peasants' damaged rights are: the defective system of land expropriation; the disadvantages of the lost-land peasants' employment; the unclear definition of property rights of land; the problems of social security in the county under dual economic structure. Using domestic and international experience of guaranteeing land-lost peasants' legal rights for reference, some proposals are presented: to regenerate the system of land expropriation , to guarantee releasing the cost of land expropriation and land compensation on time; to establish and perfect the system of social security in the country for solving the problems of land -lost peasants' social security; to do well with peasants' re-employment for bringing about the vast space for the lost-land peasants; to advance and improve the basic construction of democracy and legal system.
