China’s urbanization process moves forward constantly, which produced on a huge demand for the rural collective land. As rural land expropriation, the problem of landless peasants is appeared. In current and future stage, the problem is our country’s major theoretical and practical problem of economic and social development. Therefore, the research on the problem of the land-losing farmer has important theoretical and realistic significance.Passive generation of landless peasants is the product of the development of industrialization and urbanization, and the necessity of the economic and social development. However, in the current urban-rural dual economic and social institutional structures, land for farmers still bears the basic material production and life functions. The rural social security system is not perfect at present stage; the lands also bear the farmers’social security function, and have a significant role on the farmers’ survival and development rights. For the rural farmers who live on the traditional agricultural production, losing land means losing their major life source materials and the basic materials of production development.This research starts from the background of the current development of our country’s urbanization, taking the existing problems of rural collective land requisition system in the course of practice as the cut-in point. It focuses on the current analysis of the urban-rural dual structure system background of our country, resulting in the loss of the survival and development rights of landless peasants. The study also puts forward the practice of legal theory problems which existed in current land requisition system in our country, the definition of "public interest", land requisition compensation, etc. At the same time, the study puts forward some corresponding policies and recommendations during the process of researching and summarizing the policies and social practice in the specific situation all over our country to reform the current rural collective land requisition system and the development of rural social security, and to ensure employment and development of landless peasants.
