A Study On The Decomposition And Guarantee Of The Rights And Interests Of Landless Peasants In The Process Of Urbanization

Under the call of the management of urbanization and Investment promotion and capital introduction, a lot of land has become commercial land,in the name of land requisition.There is the different degree of " Enclosure boom " from place to place, so that the rights and interests of farmers are infringed by different degree from the landless before to after. For land-lost farmers, on the one hand, they lose the means of production supporting living expenses,on the other hand, after the land expropriated, there is a big discrepancy between the protection provided by the relevant units and their interest preference, concreting manifestation in:1.Their economic rights and interests are infringed in the context of the unclear ownership of the land,the incomplete land property rights, and the land development rights without considering.2.Under the background of the unmatched pension measures, discrimination in children’s education and employment security becoming formality, their social rights and interests are violated. To solve the problems of existence and development of the increasingly large population, it is necessary to perfect the cause of their Social and economic rights and interests damaged article by article.I compiled all walks of life in recent years, found that the main focus of research around compensation landless farmers after resettlement measures and social security levels. And I find there is not a lot of discussion from the perspective of rights, therefore, I am interested in the rights of landless peasants systematically discusses the pros and cons.From the perspective of economic rights, social rights, and political rights, the author decomposes the concept and connotation of right. Breakthrough in the relevant rights and interests of land-lost farmers on the surface, the author focus on introducing their gain and loss in economic and social rights and interests protection actually. Then conclude the reasons which cause the damage to the rights and interests of and-lost farmers on the theoretical level. Take a field research with the land-lost farmers of Chenggong District of Kunming as a sample, analyze the reasons of land-lost farmers’ losses in economic and social rights and interests protection. And according to the causes, work out measures for improvements one by one.The pace of urbanization is accelerating today. There should not only ensure steadily promoting urbanization, but also assure that the land-lost farmers’ rights and interests are not violated. We must persist in making overall consideration for efficiency and fair in the level of economy and social security, in order to realize Pareto optimality of the country’s economic development and farmers’ rights and interests protection. With the hope to offer some help to the department concerned to improve the corresponding rights and interests of the land-lost farmers, the author makes suggestions from two different levels and seven points of view. From the economic rights and interests safeguard level, there is four points including the clarity of land property rights, the exercise of "public interest", the consideration of land appreciation, and the perfection of compensating mechanism and expropriation procedure. Then we can find out the following another three perspectives: providing for the aged, children’s education, and the implementation of employment policy, from the social rights and interests protection level.
