Land Management Behavior Abnorm Of Local Government And Relevant Prevention Research

Local government is both of the major governor local affairs and the primary driver and institution responsible for the local economic development. Since the 3rd Plenary Session of the 11th Central Committee of the Communist Party of China in 1978, Chinese government has initiated an overall reform in economic system. Local government, as driving the economic system reform, has greatly changed its actions, especially the function and method of economic management. Conversion from plan economy to market-oriented economy is a long way to be covered step by step, so it's impossible for the government to make its role adaptive to the market-oriented economy instantly. Abnorm of the local government in land management just mirrors its inappropriate application of its function. There are many factors that result in such abnorm result, including the land management system and deficient legal system. The main cause is that during the converting period, the local government considers it as "Powerful Authority" and interfered too much in economic activities. Furthermore, restricted by traditional political performance evaluation mode, the local government had a misunderstanding in its development form, i.e. it only pursued high GDP, for which illegal use of land occurred inevitably. The writer, according to the relevant articles in Land Management Law, adopts the theory of sustained development, the human technology and governance for people, and uses the policy and rules concerning land management to analysis the land management abnorm by local government, and raises some preventive measures. Based on the research into land management abnorm by local government, the writer appoints out its three characteristics: difficulty in punishment in law, pretense on "collective decision" and hidden use of land. In addition, the writer expounds the harms of land management abnorm: much reduction of cultivated area, grave infringe upon farmers' interests, more chances corruption, bad influence the reputation of government and the dignity of law. This paper analyses the general reason for land management behavior abnorm of local government in several aspects like law, system and policy related to land management, meanwhile, further analyses the profound reason for land management behavior abnorm of local government in comprehension, mechanism and benefit of land management. Finally, based on several aspects including amendment and perfection of the Land Management Law, enhancing and deepening the state's management function in land, transforming land management function of local government, this paper puts forwards measures for preventing land managementbehavior abnorm of local government. It is hoped that this paper can be beneficial to prevention and control of land management behavior abnorm of local government.
