Impact Research And Enlightment Of Copyright Law Of Europe And USA On Digital Preservation

As society develops and technology advances, digital information resource is becoming the important object on the production, dissemination and utilization of information. The large-scale storage and long-term preserves of the digital resources is challenging the traditional work of digital libraries and other information organization. Many topics about the technology, fund, legal in the digital preservation activity should be researched. This paper focuses on the aspect of the law, especially on the copyright and some related laws.The first part of the paper introduces the domestic and international research and practice in general. In the second part, the impact issues of digital preservation carried by the copyright law and related laws in America and European countries are discussed. The principal content include that it introduces the main activity of digital preservation in America and Europe and the best practice of the digital preservation in the existing law environment of several countries; discusses the current state of the copyright and related laws in these regime and their impact on the digital preservation activities; proposes legislative reform about digital preservation and other approaches in which preservation organizations such as libraries and archives can effectively implement digital preservation activity. The third part of the paper carries out a study related to the application of Chinese Copyright Law and related laws on digital preservation. In the fourth part, in the reference of the specific situation in our country and the experience from the study of the impact of European and American copyright law and related law on the digital preservation, it summarizes the enlightenment from the issues concerned with the digital preservation and copyright in China.
