The Comparative Study Of The Legal Issues In The Opening And Utilization Of Archives In China And Foreign Countries

The ultimate aim of the archives is to cultivate and utilize the archives information resources to serve all aspects of the society. But in the process of opening and utilizing archives information, various legal issues will be concerned. To investigate these legal issues is the co-responsibility of the scholars in archives and law. Since the《law of archives》being issued for over two decades, they've improved much. But the work of opening and utilization are not as good as other countries in many aspects, it is because of the incomplete of Chinese law and regulations.The dissertation is divided into three parts to discuss the differences' and similarities in the legal issues of archives opening and utilization in China and other foreign countries.The first part is the comparison of law in archives opening in China and foreign countries. It describes the connotation and meaning of the opening first, and then compares the historical background and aim, legal policy, main body, starting time, and range and content of the opening of archives. Finally, accounts the differences and similarities of the protection of the right to know the archives information in the opening of archives.The second is the comparison of law in archives utilization and publish in China and foreign countries. It describes the definition and meaning of the utilization of archives firstly, and then compares the legal procedure, utilization fee, and the legal protection of citizen archives utilization right. Finally, it is the differences and similarities in the legal issues of archives publish in China and foreign countries.And the third part is the comparison of the protection of civil rights in the archives opening and utilization in China and foreign countries. In the process of opening and utilization of archives, the right of privacy and copy right of the citizen is the critical point of civil rights protection. This chapter compares the regulations of the right of privacy and copy right in the law and regulations in and out of China respectively.
