Traced back into the western world, Presumption of Innocence is the basic principle of criminal litigation. After hundreds years'development, it has gained worldwide acceptance. As a principle for human rights protection, it contains a series concept of merits of modern civilization. This universal principle becomes one of the important symbols to judge if the judicial administration is civilized and the situation of human rights protect is well. The presumption of innocence is certainly applied to the state organs especially the judiciary, and also detective to the reports of criminal lawsuits. China Criminal Procedure Law of which was amended in 1996 has already indicates the principle, but our judicial practice has a long way to go to the special rule, so does our reports of criminal lawsuits.Beginning with problems that exists, this thesis will point out that during our reports of criminal lawsuits, there lefts a lot of problems, especially procedures, details etc, violate the very principle. In this thesis, I will introduce some basic points of the presumption of innocence, thus make the meaning, value of it, and then combine it to the characters of judiciary and the importance of human-right protection, especially the exceptive character of Chinese media to analyses the reason why it is fit to media. In order to find out where the problems are, I will discuss the sticking point of our existing regulations, at the same time, refer to the guidelines of press overseas, and analyze the existent issues. I hope this thesis can provide some useful suggestions to our media, so that they can obey the presumption of innocence principle much better.
