With the rapid development of the media, especially the sudden emergence of the internet injecting new vitality to the news media, he speed of the information dissemination, and the speed and breadth of reports reach the unprecedented position. Crime news has therefore attracted audience eyeball with its interesting and sensational character, thus become the battleground of the news media. The media report on criminal cases is now multi-directional and deeply-pictured. The criminal investigation and news report are now inseparable, especially some investigation of significant social impact, which has become the object that news media almost crazily compete for. Certainly, there is the positive aspect concerning the news media supervision on the cases in the investigation stage since news media has begun to use blogging tools to achieve the fully coverage of the case in the exercise of its basic legal rights to supervise. However, this way of supervision has negative effects generated from the fully exposure of the cases which would lead to the situation that the strong voice of public media would sometimes influence the decision made by judicial system, thus there would be the intrusion of judicial independence, invasion of privacy of the parties, and also the impact on the traditionally un-open investigation. Through a long historical evolution of media supervision, its relationship with judicial independence has been very complicated and full of conflict in some circumstances. Sometimes, news media is too busy craving for the timeliness of the news to take into account of the pros and cons of the news release, which often led to the anomie of the content, degradation of the criminal news report and caused criminal copycat seriously threatening social security. Therefore, this study focuses on the conflict between media reports and criminal cases in the investigation stage in order to regulate the report coverage in the investigation stage, which has important practical significance for the regulation of media report in our country, the offset of the adverse effects by media on the investigation to avoid the possibility of “trial by media”, and the protection of legitimate rights and interests for related parties, especially the criminal suspect and the victim. Based on the definition and the features of media report on criminal cases in investigation stage, this paper points out its problems and do theoretical analysis to put forward the main body, the form and the accountability concerning the report in the investigation stage in the hope that it will of help for the protection of related parties involved and judicial independence and judicial authority.
