Analysis Of Admittance System Of Foreign-funded Hospital In China

China starting as early as 1989, introduction of foreign capital in the medical industry. After joining to the WTO, the condition for foreign capital set up medical institutions in China gradually relaxed. On March 17, 2009, the CPC Central Committee issued"the opinion on deepening the reform of medical and health",encouraging social capital to set up medical institutions in nonprofit according to law ,but the development of China's foreign-funded hospitals are unsatisfactory. Basis in the existing legislations and policy support on the development of foreign-funded hospitals, how to formulate relevant laws, modify and improve regulations, attract more foreign capital to China run hospital and promoting the development of foreign-funded hospitals better, in order to form different patterns of running medical , is an urgent problem to be solved.This paper on the basis of defining the concept of foreign hospitals, studying the changes of access for foreign-funded hospitals, anglicizing that perfect the admittance system for foreign-funded hospitals is good for fulfilling the international obligations about the commitment for opening medical service area, reflecting the Policy-oriented and legal-oriented of attracting foreign investment for medical health , riching medical market competition to meet the rich people's high service medical demand, Promoting competition in the medical market to solve the problem of "Medical treatment is difficult and expensive",. While pointing out that admittance system for foreign-funded hospitals exists many problems, such as lacking of laws, regulations are difficult for use, the legislative level of rules is low, access forms are single, access requirements aren't clear, the negative conditions of approval and register is opaque, buying medical equipments are limited, prohibiting setting up branch shop, administrative reconsideration and administrative lawsuit cannot be used by the foreign investors.In response to these problems, find out the causes: emphasis on policy guidance , principle of reality is not full obtained in admittance system of foreign-funded hospitals ,foreign investors shall be enjoy not discrimination and the treatment of convenience are not fully met, the legal autonomy of foreign-funded hospitals does not fully reflected ,the spirit of the Property Rights Law that protect of all market subjects equally without fully reflected, administrative review agencies are lack of independence and responsibility subject is difficult to determined. On this basis, by comparing and researching the admittance system of foreign-funded hospitals in Germany,England and Australia, point out that China should abolish all restrictions about setting up wholly-owned foreign-funded hospitals,simplify approval procedures and allow foreign-funded hospitals set up branches.At last, propose solutions to perfect the admittance system of foreign-funded hospitals. The solutions are as follows: adhering to the concept of according to the law to set up and run the hospitals, to legislate"The Law on Foreign-funded Hospitals",modifying specific access rules based on actual to allow access forms diversification, developing the access criteria that can be quantified, clearing the negative conditions of approval and registration, without limiting the foreign-funded hospitals to purchase large equipment, allowing to set up branches, setting up independent administrative review agencies and unitizing approval subject to ensure the already existing legal remedies are fully opened.
