Forest resources are the main part of terrestrial ecosystems,which is important to maintenance the balance of natural ecosystems,improve the ecological environment and safeguards the national territory ecological security.In addition,the forest resources are also undertaking the important task of supplying forest product,which are our country socialist modernization's essential producer goods.This article through in-depth analysis of Chinese current situation of legal management of forest resources,point out that legal management of forest resources of our country exist missing legal principles of forest resources;short of the management of forest resources;sole of the legal mechanisms which for dispute the resolution. The problems lead to the overcutting and the overusing of the forest,as well as destroying the forest to open up wasteland and occupying the forest land,these phenomenon are very serious in the practice.Therefore,base on the successful experience of legal management of forest resources of the United States,Germany,Sweden and Russia,use scientific methods,build the legal management system of forest resources conforming to our country national condition.This article start with four aspects to build the forest resources legal management system conforming to our country national condition:establishes legal principles of forest resources, regulates the management of forest resources,improves the management of forest resources,as well as perfects the legal mechanisms which for dispute the resolution.The managed principles of forest resources established include legal principles in accordance with laws and the principles of integrated multi-stakeholder;property managed of forest resources include legal system improved of forest property rights,as well as legal system improved of commercial forest property rights;the management of improved forest resources include forest ownerships' determining and the contract's standard;the legal mechanisms which for dispute the resolution, include the systems of mediation,the systems of reconciliation,the system of arbitration,the systems of litigation and the dispute settlement mechanisms of the coordination mechanism between the co-ordination.However,in view of forest resources of the legal management and complexity of the legal management of forest resources,it is necessary to establish the perfect legal system of forest resources managed.Therefore,we should respect the history and reality of national conditions in order to preserve the sustainable development of forest resources.
