Research On The Legal System Of Paid Use Of State-owned Forest Resources

The system of paid use of natural resources plays an important role in some respects,such as promoting the conservation and utilization of natural resources,maintaining and increasing the value of state-owned assets and so on.Among them,the state-owned forest resources are important part of natural resources.Establishing a system that paid use of state-owned forest is beneficial to ensure the implementation of the national forest resources' ownership,promoting the establishment of the natural resources property rights system,improve the utilization efficiency of the state-owned forest resources and give full play to the function of market resources allocation.However,in the process of practice,the paid use of forest resources is relatively backward compared with mineral resources,the areas of water and sea and other fields.China has not formed a real legal system of paid use of forest resources.In the process of development and utilization of forest resources,legal system of paid use of forest resources claims the units or individuals pay a corresponding compensation to owners.At this point,we regard the'forest resources' as 'asset'-the valuable 'object',which has its value involved others and related to the national people's interests,so it must be carried out according to legal procedure and form the system specification.Due to the limitation of the nature of forest resources themselves,the construction of the legal system for paid use is relatively backward,which leads to the problems in the process of paid use,such as unreasonable use mode,the virtual property right of state-owned forest resources,and the value of which is not fully reflected.Therefore,it is extremely urgent to establish the system for paid use of state-owned forest resources.In view of the shortcomings and inadequacies exposed in the process of implementing the system of compensated use of forest resources in China,this paper,on the basis of determining the theoretical basis of compensated use of forest resources,puts forward that the establishment of the system of compensated use of forest resources should pay attention to the distribution of central and local income,as well as the coordination between laws and other factors.By improving the forest law and other relevant legal systems,the principle,subject,scope and method of paid use are clarified.We will improve supporting measures for paid use to provide a strong guarantee for the implementation of the legal system.
