Research On Ecology Subsidy To Forest Resource Of China

In the long historical process,people explore and use the forest resources unduly as long as they develop their economy. As the natural eco-environment of the worsening, people have realized the forest resources'economic value and ecological value profoundly, so they pay more attention to protecting the forest resources. This paper focuses on the legal system of ecological compensation for forest resources which is the most effective system. The article explores this legal system with four parts.The first part analyzes the legal system of ecological compensation for forest resources. Firstly, it is necessary to study the concept of the ecological compensation from a number of angles such as ecology and law, then we can get the concept of the ecological compensation for forest resources. Secondly, have comparation and analysis on the foreign countries'legal system of ecological compensation for forest resources. At the same time, this paper summarizes the achievements of our country's legal systems of ecological compensation for forest resources. Finally, for forest resources after making research on different countries'legal systems. With the help of above researches, we can propose the legal system of ecological compensation for forest resources.In the second part, in order to polish the legal system of ecological compensation for forest resources, the author analyses it in many ways , especially in the ways of ecology,economics,law.In the next part, the paper points out the legal system's defects in four ways. Firstly, there is no guiding concept in the legal system which is the viewpoint of ecological value. Secondly, our country has no integrated forest ownership system. The forest ownership has direct relations with the ecological compensation for forest resources, because it involves the operation,management,interest admeasure of the forest resources. Thirdly, the legal system of ecological compensation for forest resources is not in a balanced situation. But neither the Basic Law nor the executive detailed rules, which must have regulated the legal system, took no notice of it. Finally, the legal system of ecological compensation for forest resources is not consummate which is necessary to definitude in many ways.The last part polishes the regulations and laws from four aspects. The first aspect points out the importance of making foundation of the legal system of ecological compensation. Secondly , there must be a guiding concept in the construction of the legal system of ecological compensation for forest resources from lawmaking. The viewpoint of ecological value is the guiding concept. Thirdly, it says that it is necessary to consummate the legal system in the following aspects: compensation principles, compensation standards, compensation funds sources, compensation funds constructions, after supervisions. Lastly, the paper suggests to make innovations in these associated systems: the system of forest ownership, the price system, the system of Green GDP. These systems have close connections with the legal system of ecological compensation for forest resources. Only through these completed systems can we construct an equal and an effective ecological compensation for forest resources.
