Research On The Property Right System Of Forest Resources In China

Forest resources not only have good economic value,but also have important ecological value.Based on the close correlation between the development and utilization of forest resources and protection,the development and protection of forest resources has been a hot topic among many scholars.However,there are still many problems in the protection and management of forest resources.With the establishment of the ministry of natural resources in 2018 and the requirements of the overall plan of ecological civilization on the property right system of natural resources,it is necessary to study the property right system of forest resources.In view of this,this paper discusses the property right system of forest resources assets,and studies the confirmation,registration,circulation,income distribution and forest ecological compensation in the property right management of forest resources assets.The paper is divided into four parts.The first part is the discussion of the related concepts and theoretical basis of the property right system of forest resources assets,that is,the definition and theoretical support of the concepts related to the property right of forest resources assets.From the current theory of forest resources,forest resources assets,the forest resource assets property rights,the concept of the combination of the existing laws and regulations and the actual demand into consideration,such as "forest resources assets,is defined as those in forest resources property right subject is clear,clear property rights,exclusive,scarcity and economic value,in the form of natural resources intangible assets.It also provides theoretical support from the three aspects of "national ownership of natural resources","assets management of natural resources" and "sustainable development of forests".The second part introduces the specific regulations about the property right system of forest resources assets at home and abroad.From the existing laws,regulations and rules in China,this paper makes a detailed analysis of the provisions on the confirmation,transfer,transfer,income distribution and forest ecological compensation,and comments on some of them.In addition,this paper also introduces relevant foreign regulations and sorts out relevant regulations that have positive significance for the construction of China’s forest resource asset property rights system.The third part stUdies the problems existing in the property right system of China,s forest resources,mainly from four aspects.There is a lack of norms and standards in the registration of forest resources.The ownership of property right is not clear and the boundary of ownership is disputed.Lack of natural resources to confirm the right to register the relevant supporting measures.In terms of transfer transfer,there are conflicts between laws,regulations and policies on forest resource transfer due to the imperfect mechanism of forest resource transfer.The way of forest resources transfer is not standard;Forest rights transfer market supervision is not in place;Forest resource value evaluates nonstandard wait for a problem.There are also actual circulation of the process of forest management caused by fragmentation,circulation of small scale;Change the use of forest land and damage the ecological environment.In terms of income distribution,the imperfect circulation system leads to the loss of forest resource assets income.The national income shares the degree to be lower and so on.Forest ecological compensation is a single standard of forest ecological compensation due to the imperfect laws and regulations of forest ecological compensation.The forest ecological compensation fund source is single and so on question.The fourth part proposes targeted solutions.In view of the problems in the confirmation of rights registration,the guiding rules for confirmation of rights registration are proposed to guide the confirmation of forest rights registration.The government should take the lead to solve the dispute by various ways.We will improve the supporting measures for registration and confirmation of rights.Aiming at the problems of transfer transfer,the paper proposes to improve the mechanism of forest resources transfer.Innovate forest management mode,encourage forest farmer to circulate;Perfect the supervision of forest land use control,strengthen the case investigation and other measures.In view of income distribution,the paper proposes to strengthen the rectification of forest resource asset loss.The establishment of forest resources collection trust fund,the realization of national revenue sharing and other proposals.To strengthen the legal construction of forest ecological compensation;Using forest ecological services and raising funds for forest ecological compensation through multiple channels.
