Research On The Optimization Of The Establishment Of The Administration Of Ethnic Affair In China Ethnic Autonomous County

The administration of ethnic affairs of China reflected in the particularity of national conditions,regions,and nations.These three particularities require the administration of ethnic affairs to be suitable to the actual situation in ethnic regions,and in line with local conditions.If the system,law,policy are means and strategies of operating the administration of ethnic affairs,organizations are the important carrier of operating it.This thesis is on the perspective of optimized organization setting about administration of ethnic affairs in autonomous counties of minorities,and it systematically expound the questions about the present situation and basis of organization settings,characteristics,advantages,existing problems,other factors,and optimized path.From the present situation and basis of organization,the setting of administrative agencies for ethnic affairs in the autonomous counties is decentralized,organization settings and autonomous function not symmetric,and departmentalization of specialized agencies weakening and unbalancing the function.Organization setting mainly based on the theory of bureaucracy,our constitution,regional national autonomy law,organization law,and our policies.The advantages and characteristics of organization settings are reflected in the setting of administrative agencies for ethnic affairs in the autonomous counties,which fully reflects the structural characteristics of our unitary state,and take full account of the special features of ethnic areas.It is the inevitable result of the historical logic,theoretical logic and practical logic of governing the organization structure of centralism of ethnic groups.It is conducive to giving full scope to comprehensive leadership of party,and giving full scope to the organic combination between our fundamental political system and basic political system.It is also conducive to giving full scope of the enthusiasm and initiative of the people being the master of their own regions and manage their own ethnic affairs.At the same time,the administrative organization for ethnic affairs,as an important carrier,carrying the autonomous functions of the national autonomous counties,has played an active role in organizing,coordinating and serving the autonomous counties of minorities,promoting the links between ethnic autonomous counties and various departments,social organizations and the masses,and promoting various progress about ethnic autonomous county.Main characteristics of the setting of administrative agencies for ethnic affairs in the autonomous counties are as follows: First,the common functions of the government organizations and the allocation of dual functions is performed.Second,government function departments and the co-operation of the ethnic affairs commission,that is,all the functional departments of autonomous counties and special administrative agencies for ethnic affairs jointly set up in the administrative agencies of autonomous counties.Third,specialized ethnic affairs administrative agencies are set up independently.The main problems in function disposition and organization establishment are as follows: The separation of the government function from the functions of administration of ethnic affairs,the separation of the functions of regional administration from the functions of administration of ethnic affairs and the gulf of specialized managing functions.The gap between government organization and the setting of national autonomous institutions,the separation of functional department settings,and the gap between the specialized managing organization settings and functional department settings are also the main problems.Horizontal departmental and vertical step-by-step settings,which present “horizontal convergence” and “vertical convergence”,make the functional departments and specialized organization management cannot synergize.The main reason for the problem lies in the contradiction between the effective supply of the system,law and theory of the ethnic affairs administration and the actual needs of the administration of ethnic affairs in our country’s ethnic autonomous counties,and that have become the systematic and holistic problem of restricting the administrative reform and optimization of ethnic affairs.From the legal angle,though it formed the administrative regulation of the State Council and its functional departments,department rules and the autonomous regulations of national autonomous areas,specific and local regulations,however,the integrity is weak,and the administrative organization law in ethnic areas lags behind seriously.In addition,the laws and regulations of administrative procedures and administrative organizations in ethnic areas are lack seriously,and the regulated content on the promotion of institutions,functions,powers,procedures and responsibilities are also lack seriously.The management system of horizontal convergence and vertical reproduction,which is under the condition of highly centralized national system design,and the state structure and administrative organization structure from bottom to top,has restricted the operation of the administrative management agency of ethnic affairs in autonomous counties of minorities.The constitutional system of ethnic affairs in autonomous counties of minorities is not perfect,including the basic principles and working mechanisms of the legal position,authority,functions,administrative manner,organization setting,establishment of personnel and administrative procedures of the autonomous county government,and the formation of administrative function departments of ethnic affairs and the main and auxiliary specialized agencies cannot be effectively collocated and coordinated with each other,so that the administrative organization settings for ethnic affairs is set up with no distinctions,no pertinence,no timeliness,and management lacks initiative,regularity and systematization.The division of administrative authority has ambiguities in the administrative functions of ethnic affairs within the government of ethnic autonomous counties and general administrative functions.Because the administrative functions of ethnic affairs in the departments are not clear,and the functions of the specialized agencies are weak,they caused the defects in the management,the waste of management resources,and increased administrative costs,therefore deviated the requirements from the party and national administrative structure reform.Based on the above questions,this thesis puts forward effective ways to optimize the organization setting of ethnic affairs administration in autonomous counties of minorities.Objectively,we should straighten out the horizontal and vertical relationships between the administrative organization of autonomous counties and the administrative organizations of ethnic affairs,and construct the interactive,inter-embedded,vertically integrated organizational structure which is horizontal and vertical fusion.Through system reform and system innovation,the contradiction between the effective supply of the system and the effective demand of the system is solved,and the system of law and regulations is perfected.Through the system innovation to break the isolation of function disposition and organization setting,then establish an organization institution with reasonable configuration,integration of functions and settings,smooth functioning,orderly connection,and effective cooperation.Follow the history and reality,tradition and modernity;therefore achieve the organic unity of purposiveness and in conformity with regularity.Subjectively,with excellent leading cadres of autonomous counties,the fundamental aim is to enhance the leader’s awareness of mastering and using policies.They should take the initiative in utilizing the advantages of institutional law and policy advantages,location and resource advantages,and creatively carry out the capacity and responsibility of ethnic work in line with local conditions.Through the innovative,systematic,and holistic system mechanism to optimize the administrative functional settings of ethnic affairs,and orchestrating the systematic,collaborative and comprehensive institutions,we also should set up the co-governance mechanism among sectors;perfect the relevant legal rules and system guarantee and measures.These are effective ways to solve the problem of optimizing the administrative organization setting of ethnic affairs in autonomous counties of minorities.
