| With the rapid development of China’s economy and the accelerated development of urban-rural integration,most farmers choose to move to cities and towns,showing the phenomenon of the whole family moving to cities,resulting in a large number of unused residential bases.The problem of "multiple homes in one household" and "over-standard use" in rural areas has not been properly solved due to the poor mechanism of home base withdrawal,and the phenomenon of wasting land resources is serious.At the same time,the problems of imbalance in the supply of urban and rural construction land,shortage of arable land in rural areas,shortage of land for agricultural facilities,and inability of the stock of residential bases to meet the needs of distribution are frequent.The solution of these problems depends on further deepening the reform of the residential base system,among which the promotion of the policy of withdrawal of rural residential bases with compensation is particularly crucial.The homestead base plays an important role in the life of farmers,not only with the function of production and living security,but also with the function of property,and it is the last exit security for farmers who go to the city.By reviewing the relevant laws,we can see that most of the laws related to the reform of the homestead system are only general provisions,which do not have much reference value in practice and are not highly operable,and the compensation for the withdrawal of homestead bases has not formed a uniform standard nationwide.As the key subject of the paid withdrawal of residential bases,farmers have little awareness of their own rights and interests,and lack the ability to defend their rights,so they are naturally in a weak position in the game between the government and village collectives.This means that the farmers’ land rights and interests are inevitably affected to a certain extent in the process of the paid withdrawal of residential bases.There is an imbalance in the distribution of interests between farmers,the government and village collectives,and some disputes,contradictions and conflicts inevitably arise,which restrict the process of paid withdrawal.Taking the paid withdrawal of residential bases in Luxian County,Sichuan Province as an example,it is found that the economic,social and political rights and interests of farmers are not fully realized.The root causes are mainly focused on the imperfect system and laws designed at the top level,unreasonable decision-making at the policy level,fictitious ownership subjects at the village collective level,and unclear perception of farmers’ rights and interests at the farmer level.Therefore,by investigating and studying the realization of farmers’ rights and interests,this thesis analyzes the causes from the institutional level,government level,village collective level and farmers’ level,and constructs a path to protect the rights and interests of farmers who have withdrawn from their homesteads in terms of economic rights and interests,political rights and interests,and then proposes countermeasures such as improving the property rights system of homestead bases,regulating administrative behavior,playing the role of village collective,and strengthening the main position of farmers,so as to effectively protect the legitimate rights and interests of farmers who have withdrawn from their homesteads.In this way,the legitimate rights and interests of the farmers can be effectively protected,so that the reform of the house base system can be steadily promoted on the basis of social harmony and stability,and the idle house base resources can be effectively utilized to promote the comprehensive realization of rural revitalization. |
