Research On China’s One Belt,One Road,and Other Countries’ Intellectual Property Regional Cooperation

By starting from the perspective of developing countries,“The Belt and Road Initiative” as a new platform for cross-regional economic cooperation has been proposed.Therefore,the construction has put more emphasis on the connection with the development strategies of the countries along the route and the connection with the regional economic cooperation mechanism along the route.In terms of the intellectual property regional cooperation discussed in this thesis,it is an inevitable topic under the Belt and Road Initiative,so special attention and discussion are deserved due to the involvement of it in intellectual property cooperation between our country and countries along the route many times.On the basis of reviewing the development process of Chinas "The Belt and Road Initiative" and the regional cooperation in intellectual property rights,the existing and possible risks that will be faced in intellectual property regional cooperation between our country and countries along the route under "The Belt and Road Initiative" are analyzed.Then,the feasible legal countermeasures and suggestions are proposed according to this.The introduction part and four main chapters are contained in this thesis.Firstly,the background and latest progress of the proposal of "The Belt and Road Initiative" are combed.The relevant regional intellectual property system is systematically studied by comparative analysis on the laws and regulations in the field of intellectual property rights in Central Asia,Central and Eastern Europe and other regions,so that the theory knowledge can be provided for our country and countries along the route to carry out intellectual property regional cooperation.in the second place,risks and reasons for countries along the "Belt and Road" to carry out regional cooperation on intellectual property rights with China,as well as the risks and causes of regional cooperation on intellectual property rights are reviewed and sorted out respectively.According to the analysis,it is found that some problems such as big differences in legislation,lack of sound intellectual property rules and regulations for the involved companies,lack of unified coordination institutions for intellectual property cooperation,difficulties in China and countries along the route in terms of Cross-border rights protection in IP cooperation.By consulting the existing literature,drawing on the experience of extraterritorial IP regional cooperation organizations,and addressing the problems existing between China and countries along the Route,for the purpose of enhancing the regional cooperation of intellectual property between China and countries along the route,the proposal of the legal countermeasures and suggestions is made finally,including perfecting the information platform related to the intellectual property,constructing and improving enterprises overseas intellectual property rights protection system,promoting the regional cooperation of "The Belt and Road Initiative" to form intellectual property right discourse,strengthening the international legal coordination mechanism construction,etc,then some enlightenment for the avoidance of risks and handling disputes can be provided in this thesis.
