Institutional Interpretation Of Applying Blockchain In Intellectual Property Protection:Logic,Dilemma And Optimization

Blockchain,also known as distributed ledger technology,is characterized by decentralization,distrust,anonymity,imtamability,traceability and transparency of data.Blockchain technology integration application change in innovation and new technology industry plays an important role,in the face of the current Internet environment of facing the intellectual property industry,made three rights,focused spot problems,the application of blockchain technology characteristics with its core technology,can provide intellectual property management,cash flow,lead to huge push value distribution and so on.However,the application of blockchain technology in intellectual property protection is also a double-edged sword at the present stage,which will cause a series of institutional dilemmas as well as technical risks.We also need to pay urgent attention to it.Guided by the theory of institutional change and coevolution,this thesis interprets the institution of applying blockchain technology in intellectual property protection by literature analysis and normative analysis.And it is no longer limited to analyzing the shortcomings in application from a purely technical dimension.This thesis summarizes the institutional dilemmas in the process of applying blockchain in intellectual property protection by analyzing the basic institutional logic.These dilemmas are as follows:legal preparation and system arrangement are not sound,supervision mechanism and supervision system are not perfect,the application of blockchain has an impact on China’s intellectual property system,the application of blockchain challenges China’s data protection system,blockchain smart contracts are incompatible with contract laws.Then focus on the above dilemmas,analyze the causes of the problems from the perspective of the system itself,the characteristics of technological elements and the interactive relationship between the system and technology,and combining with China’s national conditions put forward that institutional optimization can be realized by constructing a perfect legal system supplemented by technical support.It will help improve the application ecosystem of "Blockchain + IP".The application of blockchain technology is still in its early stage in China and is still in the process of iterative popularization.Through this study,the application of blockchain technology in intellectual property protection can be re-examined.If the above institutional problems can be solved,it will not only strengthen the legal regulation and supervision of blockchain intellectual property,but also become a sharp weapon to improve the digital intellectual property protection,and finally realize the deep integration and benign synergistic development of blockchain technology and intellectual property rights rule of law,accelerate the scale of technology application and realize leapfrog development.
