| The development of new energy in China can be traced back to the implementation of small hydropower and biogas in rural areas in the early years of the country.With the successive introduction of various laws,regulations and policy documents,the development of new energy has been remarkable.To date,a complete clean energy equipment manufacturing industry chain has been established,and the world’s largest electric vehicle charging and hydrogen refuelling network has been built,making a positive contribution to global emissions reduction.However,the development process of "wind","abandoned wind and light",new energy vehicles fraudulent subsidies,spontaneous combustion and other problems have exposed the shortcomings of new energy regulation.The lack of a sound regulatory legal system and imperfect institutional mechanisms may become a stumbling block for the development of new energy.The introduction of the "double carbon" target has pushed the development of new energy to a new level,which not only poses new challenges to the improvement of the regulatory system of new energy,but also makes it more urgent to solve the original problems of new energy regulation.This paper takes "double carbon" as the basis,starts from the perspective of regulatory legislation,regulatory system,regulatory objectives and methods,and conducts research on new energy regulation,analyzes the legal problems of new energy regulation in China under the background of "double carbon",and provides a good institutional guarantee for the development of new energy.This paper is a study of the legal problems of new energy regulation in China in the context of "double carbon",so as to provide good institutional protection for the development of new energy.In addition to the introduction and concluding remarks,the text is divided into four parts:The first part is an overview of the basic theory of new energy regulation in the context of "double carbon".The first part analyses the strategic significance of the "dual carbon" objective,i.e.to contribute to the achievement of the goal of carbon emission reduction without affecting China’s economic development,and to enhance the service function of the ecosystem,thus achieving a win-win situation for both the economy and the ecology.The analysis of energy regulation is based on two different perspectives: economics and law,and economic law.On this basis,the concept and scope of new energy are clarified,and the special characteristics of new energy regulation in the context of "double carbon" are pointed out.In the second part,the problems of new energy regulation are identified in the light of the actual operation of new energy regulation.This part focuses on the system,objectives,targets and contents of new energy regulation,the approach,and the support of policies and legislation,and identifies areas where the current new energy regulation is not compatible with the "dual carbon" policy.The third part examines some overseas new energy regulatory systems,and analyses and compares them from the perspectives of regulatory legislation and regulatory system improvement,in order to provide lessons for the improvement of China’s new energy regulatory system.In addition,the latest practices of new energy regulation in relevant countries under the background of "double carbon" are reviewed to provide lessons for the improvement of China’s current new energy regulatory system.The fourth part integrates the aforementioned issues and proposes suggestions for the improvement of the current legal framework of new energy regulation from the perspectives of policy legislation,allocation of regulatory functions,reshaping of regulatory elements and strengthening the interface and collaboration between sectoral laws. |
