| With the growth of population,economic and social development,the increasing shortage of environmental resources,and the intensification of the world energy crisis,it is imperative to control the total energy consumption and adjust the energy consumption structure;At the same time,the greenhouse effect caused by a large number of greenhouse gas emissions is also deeply troubled by us,in order to call on all countries to jointly reduce greenhouse gas emissions,China took the lead in the international community to make a commitment,committed to strive to reach the peak of carbon dioxide emissions before 2030,carbon neutrality before 2060,referred to as the "dual carbon" goal.In this dual context,the energy use right trading system is favored,which takes the total energy consumption control as the basis,and then allocates the total energy consumption target to each energy user in the form of energy consumption indicators,and allows the trading entities to buy and sell energy use indicators in the market,and finally designs a market supervision mechanism to ensure the smooth operation of the energy use right trading market.In nature,the energy use right trading system is a typical economic incentive system,relying on market mechanisms to promote the optimization of resource allocation,highlighting its unique advantages in energy conservation and emission reduction,"untying" the dependence of economic development on fossil energy,and promoting green development in the energy field.At present,the development of China’s energy-using right trading system is still in the early stage,and the pilot practice is only more than seven years,during which some experience has been accumulated and some setbacks have been encountered,which has exposed the problems we have in the construction of the energy-using right trading system.In order to make up for the existing shortcomings,this paper analyzes the existing problems from the perspective of legal regulation,combined with the current practice of the energy use right trading system in the pilot,and puts forward suggestions for improving the legal system of energy use right trading,so as to help the energy use right trading system be fully realized in China as soon as possible.This paper is divided into four parts: introduction,text and conclusion.The introduction mainly introduces the background of the topic selection,the purpose and significance of the research,as well as the research status and development level of the energy trading system at home and abroad.The text is divided into the following parts:The first part is the overview and summary of the core concepts and basic theories of "double carbon",energy right,energy right trading legal system and related systems.This paper firstly explains the concept of "dual carbon" and its important ways to realize it.Then the basic connotation of energy use right is analyzed.Finally,it compares and distinguishes the legal system of energy trading with the relevant system.The second part is the analysis and research on the status quo and dilemma of our legal system of trading power.In this part,data analysis is carried out mainly through the relevant information released by Peking University Talisman website and the energy trading platform in various pilot areas,trying to find out the specific problems existing in China’s legal system of energy trading,and analyze the main causes of the problems.The third part is to investigate and learn from the relevant theories of systems and mechanisms with the same basic principles outside the region.This part mainly summarizes the experience and enlightenment conducive to the development of China’s legal system for energy use rights trading by analyzing the operation principle of the white certificate trading system,energy efficiency quota and energy certification mechanism,and examining their practice status in different regions.The fourth part is to put forward some opinions and suggestions on the improvement of China’s legal system for energy use right trading.This part mainly corresponds to the content of the second part,and at the same time combines the extraterritorial experience of the third part,and makes suggestions from the aspects of linking with the "dual carbon" goal,the construction of the legal and regulatory system,the initial allocation mechanism and trading system,the market supervision system,and the coordinated development with other relevant systems,so as to ensure the scientific,reasonable and effective implementation of the legal system for energy use right trading,and help the realization of the "dual carbon" goal. |
