Practical Dilemma And Legal Construction In Dealing With Renewable Energy Abandonmen

Although China has become the country with the largest cumulative installed capacity and new installed capacity of wind power and photovoltaic power generation in the world,in practice,the large amount of renewable energy curtailment caused by "abandoning wind" and "abandoning light" is still serious,resulting in a waste of a lot of resources.Renewable energy curtailment refers to the phenomenon that renewable energy power generation enterprises are forced to abandon the generated electricity due to oversupply in the process of using renewable energy such as wind energy and solar energy for power generation.In terms of the refinement and expression of the problem,"coping with renewable energy curtailment" and "responding to climate change" are similar issues,which are urgent problems that need to be solved at present,and corresponding legal measures need to be taken.The practical dilemma of curtailment of renewable energy is not only reflected in the prominent contradiction between the supply and demand of renewable energy,but also reflected in the impact of renewable energy curtailment on the process of rural revitalization and the realization of the "dual carbon" goal.In the past,legal research rarely studied the legal relationship between renewable energy electricity supply and demand,and the lack of attention to the legal relationship between renewable energy electricity supply and demand was subject to state intervention.This paper deeply analyzes the legal relationship between renewable energy power supply and demand,introduces the justice interpretation of energy justice,social justice and climate justice in response to renewable energy curtailment,and also reviews the current renewable energy laws and policies,and constructs a renewable energy legal system that deals with renewable energy curtailment: renewable energy rationing system,tilted protection system,and carbon reduction incentive system.This can not only provide practical support for solving the problem of renewable energy curtailment,but also help improve an institutional framework to promote the green and low-carbon development of energy.
