Research On Energy Legislation Under The "Dual Carbon" Goal In China

Since the proposal of the "dual carbon" strategy,relevant strategies have had a significant impact on China’s energy industry.The legal community has also explored and studied how to use legal systems to regulate energy development in the context of"dual carbon".The energy legislation under the background of "dual carbon" is based on legislative revisions to help reduce carbon emissions in the energy industry,stabilize the economic order in the energy sector,and establish a harmonious and beautiful natural environment.Relevant international legislation mainly includes the United Nations Framework Convention on Climate Change,the Paris Agreement,etc.There are many problems in China’s current energy legislation,which is currently insufficient to fully address the background of the "dual carbon" strategy.Therefore,it is necessary to find reasonable countermeasures.China is the world’s largest emitter of greenhouse gases.Like other countries in the world,China has adopted more policy measures in energy legislation to address climate change before formulating laws.Currently,China’s energy laws and regulations in the context of "dual carbon" are insufficient to support long-term and effective management of energy affairs.Faced with the challenges of the era brought about by the "dual carbon" strategy,China should establish a correct legislative concept,pay attention to the adjustment and integration of laws and policies,gradually and steadily legislate.Reasonably design a complete and standardized energy law system under the background of the "dual carbon" strategy.The first chapter of this article introduces the "dual carbon" strategy and China’s energy legal system.Chapter 2 proposes legislative suggestions on how to modify the provisions of the Energy Law(Draft for Comments)based on the "dual carbon" goal.Chapter 3 proposes legislative suggestions for the Single Energy Laws based on the "dual carbon" goal,including revising the current Electricity Law and introducing the Hydrogen Energy Promotion Law.Chapter 4 proposes legislative suggestions for other important energy fields that have not yet been legislated based on the "dual carbon" goal.Chapter 5 provides a summary and outlook on energy legislation under China’s "dual carbon" goals.Strive to establish a Chinese energy legal system that conforms to the "dual carbon" strategy by legislation and appropriately modifying existing energy laws.
