With the popularization and development of Internet technology,e-commerce has ushered into a new development stage.E-commerce platforms such as T-mall,JD.com and Taobao are integrated with daily consumption life.By 2021,the number of online shopping users in China has reached 842 million.Using the Internet to obtain goods or services has become a part of people’s daily life.At the same time,the booming development of e-commerce brings many problems.The legal protection of consumers’ personal information is particularly prominent.This paper is divided into four parts,respectively discussing the particularity,the legal protection and the existing problems.Finally,through the comparison this paper puts forward personal suggestions for improving the legal protection of e-commerce consumers’ personal information in our country.First of all,the paper makes it clear that the personal information of e-commerce consumers refers to the collection of information that can be used to directly or indirectly identify individuals when they obtain commodities or services for life consumption through the Internet.It has great commercial value and it is easy to be subjected to special forms of infringement during processing.The personal information protection law in our country can be seen that it is still does not take into account the complexity and particularity in E-commerce field.At the legislation,it is not closely connected,and does not pay enough attention to the realization of strong property attributes.At the platform supervision,the undifferentiated legal supervision makes the current regulatory concept inconsistent with the actual characteristics,and the self-discipline regulations is weak.On the relief of consumer’s personal information infringement,the information holder’s personal information disclosure obligation is not fully fulfilled,and the requirement for consumers to provide evidence is high.In order to explore ways to solve the above problems,this paper fully compares the legal experience of personal information protection in the United States,the European Union,Japan and other non-regional countries or regions.This paper put forward the relevant improvement suggestions from China’s actual situation and guiding policy. |
