Research On Community Conflict Resolution Mechanism From The Perspective Of Collaborative Governance

The Third Plenary Session of the 18th Central Committee of the Communist Party of China proposed to deepen reform comprehensively and promote the modernization of the national governance system and governance capacity.The report of the 19 th National Congress of the Communist Party of China also proposed to build a social governance pattern of common construction,governance and sharing,providing new directions and ideas for social governance in the new era.However,China is currently in a period of social transition,which is both an important strategic opportunity period for social progress and development,and a period in which many contradictions in the social field are highlighted and intertwined.As an important field of social governance,the community is the "staging ground" for many social conflicts.Therefore,in order to effectively resolve community conflicts and disputes,it is necessary to establish a sound mechanism for the diversified resolution of community conflicts and disputes,which is also an innovative move to promote the modernization of community governance.Under the leadership of the Communist Party of China,it has become an inevitable trend for community development to actively promote the collaboration among multiple subjects,such as the government,courts,neighborhood committees,social organizations and community residents,and strive to realize the effective connection of various mediation methods,work together to resolve community conflicts and disputes,and continuously improve the level of community governance.It is necessary to analyze the internal logic of this process in order to explore the construction path of the mechanism of diversified settlement of community conflicts and disputes.Guided by the theory of collaborative governance and combined with the research results of previous scholars,this paper constructs a theoretical analysis framework of the mechanism of diversified settlement of community conflicts and disputes.The whole analysis framework consists of five parts: external environment,collaborative dynamics,collaborative mechanism,collaborative behavior and collaborative results,which are interlinked and inseparable.The case selected in this paper is the construction of a "lawsuit-free community" in Community D of Dayi County,Chengdu.In the process of building a "lawsuit-free community",community D has formed a "Party-led,government-led,judicial-led,departmental participation and community autonomy" mechanism for the diversified resolution of community conflicts and disputes,which is consistent with the theoretical analysis framework of this paper.The study found that a relaxed political environment and an inclusive and open social environment provide a favorable field for community D to build a "litigation-free community".The leadership of the Communist Party of China and the government,the multiple pressures on governance actors,the interdependence of multiple actors,and the ideological consensus that has been formed provide the impetus for the collaborative governance process.In order to maintain the effective operation of the whole collaborative process,it is necessary to construct effective participation mechanism,organizational linkage mechanism,interest integration mechanism and cultivation support mechanism.Under the premise that the above four synergistic mechanisms work,the multiple subjects have started to act and take advantage of their own strengths to devote themselves to the resolution of community conflicts and disputes,realizing a community conflict governance pattern of common construction,common governance and sharing.At present,China’s community dispute resolution mechanism is still in the development stage.The analysis of the construction of a "lawsuit-free community" in Community D of Dayi County can provide corresponding experience to improve the dispute resolution mechanism.In terms of subject capacity,we should enhance leadership of the Communist Party of China,strengthen the government’s sense of responsibility,improve the professionalism of social organizations,and activate the motivation of community residents to participate.In terms of synergistic mechanism,we should continuously improve the effective participation mechanism,organizational linkage mechanism,interest integration mechanism and cultivation support mechanism.Based on the theory of collaborative governance,we analyzed the mechanism of diversified settlement of community conflicts and disputes,with a view to providing some reference for the settlement of conflicts and disputes in other communities.
