A Case Study On The Source Of Action Governance Of The People’s Court Of S City, Sichuan Province

With the rapid growth of the social economy,social conflicts are characterized by complexity and diversity.Resolution of conflicts and disputes has become an important content of social governance,which is the cornerstone of economic development,social harmony,and livelihood security.The source of litigation governance emerged as the times require.As the promoter of source of action governance,it is of great theoretical and practical significance for grassroots courts to systematically explore and comprehensively analyze the practices and achievements of source of action governance in grassroots courts.Secondly,in-depth analysis of the case is conducted from three aspects: the definition of top-level design,the practice of top-level design,and the effectiveness of top-level design.The rationality of the litigation source governance system in S City is analyzed.This paper analyzes the multiple coordination in the front end of the litigation source governance of S City Court from three aspects: the main practices of the multiple dispute resolution mechanism,and the effectiveness of the multiple dispute resolution mechanism.Based on the governance of derivative cases within back-end litigation,the resolution of conflicts and disputes is further stopped within litigation,reducing the emergence of secondary conflicts.Through analysis,this article draws empirical inspiration: top-level design is the premise of source of litigation governance.The governance of litigation sources cannot be accomplished by a court alone.It requires integrating resources from various aspects such as administrative organs,judicial organs,and social organizations,obtaining support from the Party committee,striving for local government resources,strengthening departmental coordination,and scientifically formulating work plans,providing policy,resource,and information coordination support for the governance of litigation sources,and providing a good guarantee for the implementation of litigation source governance.Making good use of multiple dispute resolution mechanisms is the foundation of litigation source governance.The multiple dispute resolution mechanism is an effective solution path for the initial stage of conflict and is the front-end path for litigation source governance.By building a litigation mediation docking platform,the dispute resolution process can be effectively filtered;Developing mediation organizations can enrich diverse dispute resolution forces and improve the professional team of diverse dispute resolution;Giving full play to the review mechanism of social governance is conducive to comprehensive and active participation in social governance and improving the efficiency of grassroots social governance.Focusing on the governance of derivative cases is the focus of the source of litigation governance.Through risk assessment management and litigation quality and efficiency management,S City Court has effectively strengthened the risk control of conflicts and comprehensive node management.Through integrated network,electronic information,and other technologies,it has internally optimized the organizational structure.Through the separation of trial and assistance mode,it has provided a good environmental factor for judges to focus on preventing derivative cases,and effectively reduced the pressure on resource allocation in terms of human,material,and financial resources.After the comprehensive treatment of litigation sources by the People’s Court of S City in Sichuan Province,the mechanism setup has been basically improved,and various links have been managed in an orderly manner,providing strong support for social stability and development.Through the effective practice of the People’s Court of S City in Sichuan Province,the relationship between litigation source governance,dispute resolution,and social governance has been well handled,ensuring the orderly progress of litigation source governance work,and providing useful ideas for grassroots court litigation source governance and social governance.
