Study On The Dilemma And Countermeasure Of People’s Court’s Participation In The Management Of Litigation Source

With the reform of litigation cost and the implementation of registration system of filing cases,and made it easier to participate in the litigation.The increase in the number of cases has brought unprecedented challenges to the work of the court.In order to alleviate the problem of litigation exhaustion,using the limited judicial resources to resolve difficult cases,the "source of governance" which resolve contradictions and disputes from the source has become a social consensus.It is necessary to analyze the connotation of litigation source governance,as well as analyze the relationship between it and related concepts,and explore the necessity and feasibility of the court’s participation in the governance of litigation sources.This paper takes X county court of Hunan Province as an example,analyzes the current situation of the court’s participation in the governance of litigation sources.It is found that there is still institutional vacancy in the process of participating in the governance of litigation sources,lack of the total allocation of personnel and the governance mode of participating in litigation source,as well as the court’s insufficient governance of the litigation source of the resurrection cases.The main reason why the court of X county encountered difficulties in participating in the governance of litigation sources is that the court does not pay enough attention to the governance of litigation source,uncertain its position in the fields and lack of financial support.In view of the above problems,firstly,we should clarify the role of the court in the governance of the source of action according to the connotation of the governance of the source of action,pay attention to the source prevention and pre litigation governance of disputes.Secondly,according to the characteristics of family disputes,contract disputes,infringement disputes and other disputes,determine the way and method of the court to participate in the source of action governance.And focus on key areas and promote the governance of litigation sources.Lastly,we should strengthen the financial guarantee for the court to participate in the governance of litigation sources.And the information technology is used to improve the effect of litigation source governance.
