The Governance Of Litigation Source In Our Country From The Perspective Of Social Governance Modernization

Promoting our country’s modernization of social governance requires improving the ability to resolve social conflicts in our country,and carrying out the governance of litigation source is an important way.Since it was included in the "Framework of the fifth-five year judicial reform" in 2019,the governance of litigation source has now become a phenomenal political issue and reform term in our country.However,the governance of litigation source still faces many dilemmas in specific practice.The original intention of alleviating the contradiction between the court and the case has not been well realized,and the governance effect expected by the top-level design has not been achieved.It is one-sided to look at the governance of litigation source work only from the perspective of dispute resolution.Therefore,the governance of litigation source work should be analyzed from the perspective of the modernization of social governance and its relationship with social governance should be clarified,so as to further explore the path to improve the governance of litigation source system.In the perspective of the social governance modernization,the governance of litigation source should take "co-construction,co-governance and sharing" as the spiritual core and "discourse theory" as a theoretical basis.Two basic ideas are followed in practice: firstly,adhering to "multi-governance",making the governance model systematized,governing subjects diversified,and clarifying governance responsibilities;secondly,"promoting effective communication",rationalizing the concept of communication,intelligentizing the means of communication,specializing communication team.By carrying out cooperation and efforts from the CPC committees,government,court,society,citizens and diverse parts,relying closely on the governance of litigation source framework of "led by the CPC committees and implemented by the government,social coordination,broad participation and legal guarantee".Improve the comprehensive governance system with multi-agent participation,as well as the diversified and three-dimensional dispute resolution methods and systems.Ensure comprehensive,rational and standardized communication,fully stimulate the vitality of the main body to participate in the governance of litigation source,and enhance the ability to resolve social conflicts,thereby promoting the modernization process of social governance.
