With the acceleration of urbanisation,the number of disabled elderly people is rapidly increasing,and the problem of long-term care for children of elderly and low-income families will become increasingly prominent.The issue of long-term care for the disabled elderly is a product of economic and social development and a future development of an ageing society.The increase in the proportion of the disabled elderly and how to meet the long-term care needs of the disabled elderly and protect their legitimate rights are issues that need to be addressed in the current process of economic development in China.This article focuses on the legal problems of long-term care for the disabled elderly in the existing social security system in the context of an ageing population,and draws on the experience of the United States,Germany and Japan to improve their care systems and legislation,and to make recommendations on the existing legal problems in the light of the relevant domestic laws and regulations and the implementation of the long-term care insurance system implemented in 49 pilot cities,with a view to improving and streamlining the care The legal system for caring for the disabled elderly.The article is divided into five parts.A study of the current status and dilemmas of legislation on long-term care for the disabled elderly in China.In the first part,an analysis is made through an overview of long-term care for the disabled elderly,defining the disabled elderly and related concepts,as well as the relationship between long-term care for the disabled elderly and social insurance;in the second part,a summary and sorting out is made from the relevant policy provisions and relevant laws and regulations in the existing system,and the current legal situation of long-term care for the disabled elderly in China is put forward;in the third part,an analysis is made to study the existence of long-term care for the disabled elderly in China In the fourth part,the legal problems of long-term care for the disabled elderly in China are analysed in the light of the actual situation in China,and reference is made to the judicial practices of foreign countries and regions,mainly the experience of the United States,Germany and Japan;in the fifth part,from the problems of personal rights and interests,property rights and interests,medical protection and caregiver supervision,the legal problems of long-term care for the disabled elderly in China are summarised and sorted out.four aspects,and proposes measures to improve the legal framework for long-term care for the disabled elderly in China,based on the current situation of the protection of the rights and interests of the disabled elderly in China.
