Cyber violence is a negative product of the Internet era,which evolves and develops with the continuous progress and popularity of Internet technology,and has become one of the cyber hazards that cannot be ignored today.In this paper,we use literature research method,data analysis method and case empirical analysis method to sort out the phenomenon of cyber violence crime in China,put cyber violence in the field of criminology,and discuss the development trend and regulation status of cyber violence crime,focus on the legal aspect,and put forward corresponding suggestions for the regulation of cyber violence crime,in order to prevent and control it and make effective In addition to the introduction and concluding remarks,the article also provides an overview of the legal aspects of cyber violence.In addition to the introduction and conclusion,the article is divided into four main chapters:The first chapter is a general overview of cyber violent crimes.Firstly,the concept of "violence" and "cyber violence" is elaborated,and then the concept of cyber violence crime is clarified based on the relevant theories of criminal law and criminology,and the types of current cyber violence crimes in China are sorted out and classified into It is divided into human flesh search type cyber violence and language type cyber violence,among which language type cyber violence is divided into insulting language violence and cyber rumors.Chapter 2 summarizes and analyzes the development trend of frequent cyber violence crimes.The means of cyberviolence crimes are changing under the influence of new media development,and the crime subjects are characterized by group blindness and bullying,while the cost of cyberviolence crimes is low,but the consequences caused are difficult to predict.Influenced by the younger structure of Internet users and the younger age of minors touching the Internet,the subjects of cyber violence crimes are developing in a younger way,and the hot spots of cyber violence are also shifting from celebrities to unspecified ordinary people.In addition,the development of new media has also intensified the diversification of the means of cyber violence.Due to the addition of the commercial operation mode of capital,a huge number of "cyber pushers" have emerged,and cyber violence is increasingly used in commercial competition,showing the development trend of gradually forming an organized and planned industrial chain of cyber violence.Chapter 3 introduces the current status of regulation of cyber violence crimes in China.In terms of legislation,there are problems of fragmentation of concepts between sectoral laws,crimes against citizens’ personal information and regulation of human flesh search cannot be fully matched;in terms of justice,there are problems of difficulties in obtaining and proving evidence for victims of cyber violence crimes and imperfect relevant judicial interpretations;in terms of administration,there are problems of unclear division of responsibilities among administrative departments and weak professionalism of law enforcement teams.Chapter 4 puts forward corresponding suggestions for the regulation of cyber violence crimes.According to the analysis of the current development of cyber violence crimes and the current situation of cyber violence crime regulation,this paper puts forward three suggestions on the regulation of cyber violence crimes: in the legal aspect,optimize the interface between criminal law and departmental law and improve the relevant legal provisions involving cyber violence,and solve the problem of difficult evidence collection by improving the relevant provisions of electronic evidence,in addition,it is also necessary to clarify the problem of cyber In addition,it is also necessary to clarify the subjects of responsibility for crimes of cyber violence and related responsibilities.In the technical aspect,we should set scientific and reasonable obligations for network service providers,plus explore the construction of a technically accurate identification model of cyber violence,and consider the establishment of a graded disposal mechanism for cyber violence information.In the social aspect,it is necessary to strengthen the safety education of minors on cyber violence and raise awareness of the prevention of victimization of cyber violence crimes.
