| With the further development and application of network technology,the number of Internet users in China is growing rapidly.The surge of internet violence has gradually become a major problem in China.Cyber violence is initiated by a small number of people with the help of the network platform,which causes the public opinion to attack specific objects,so that specific objects can bear the continuous mental pain.Through the analysis of relevant cases and network hot events,this paper makes it clear that the emergence of network violence is attributed to the virtual and anonymous nature of the network,the lack of independent thinking ability of Internet users,the imperfection of relevant laws and regulations,and the aggravation of social contradictions,showing the characteristics of large hidden subject,rapid and easy to get out of control and bullying.Network violence not only infringes the rights and interests of the victims,but also destroys the authority of justice to a certain extent,and has a bad impact on the construction of a harmonious society.From the perspective of legislation,judicature and law enforcement,there are some problems in the regulation of cyber violence in China,which leads to the governance of cyber violence can not meet the expectations.Therefore,this paper thinks that we can improve the legislation of network supervision in legislation,and put the serious network violence into punishment,and introduce the right to delete personal information;in law enforcement and justice,we should increase the punishment of the subject of responsibility for network violence,implement the network real name system and strengthen the supervision of network operators;in social governance strategy,we can establish a multi department joint governance mechanism In order to improve the current situation of network violence governance and promote the effectiveness of network violence regulation,we should strengthen the self supervision and management of the network industry,and build the supervision mechanism of schools and families for minors. |
