Research On The Legal Regulation Of Cyber Violence

The rapid development of information and communication technology has led to the emergence of an open information society with free dissemination of information.After nearly30 years of development,China has become a major network country,and has gradually moved towards becoming a powerful network country.The number of network users has increased year by year,reaching over one billion.The Internet has also spread to almost every household,and the construction of the Internet has made amazing progress.The development of the Internet has provided practical possibilities for the free dissemination of information,and has also greatly stimulated the impetus for the progress and development of human society.The Internet injects innovation into business and economic models,and has far-reaching implications for individuals,organizations,and society in all aspects.At the same time,due to the vigorous development of self-media and mobile internet,as well as the application of various technical means,the traditional information dissemination pattern has been transformed,gradually forming a new pattern of decentralization,posing challenges to the traditional power relationship of social governance.In recent years,the frequent reports of online chaos in the media have fully exposed the current situation that the governance of online violence in China is not yet perfect.At present,the legal regulation system of cyber violence in China is still not perfect,and how to effectively manage cyber violence through legal channels has become a topic of theoretical and practical significance.Based on this,this article is entitled "Research on the Legal Regulation of Cyber Violence".In addition to the introduction and conclusion,the full text is divided into three parts to elaborate on the existing problems in the regulation practice of cyber violence in China,their causes,and solutions,in an effort to optimize and improve the governance approach of cyber violence in China.The first chapter of this article describes the theory of cyber violence.This chapter selects the case of "Hangzhou Woman Picking up a Courier and Being Stolen by a Rumor".First,it briefly describes the process of the incident and the referee’s results.Secondly,it analyzes the core points of the case and elaborates on the author’s reflections through the case.Finally,it leads to research on topics related to online violence and launches a comprehensive theoretical analysis of the phenomenon of online violence.This chapter specifically includes the following parts: Analysis and development of the concept and characteristics of online violence,forms of expression,and the harm caused by violence.The second chapter of this article analyzes the problems existing in the legal regulation practice of cyber violence in China,and analyzes the problems from three different aspects.The main problems in legislation include the lack of special legislation on cyber violence,vague and general legal provisions,and the existence of lag and limited legal deterrence;In the judicial aspect,there are problems such as difficulties in identifying the liability of the infringer of cyber violence and incomplete relief systems for the rights of the infringed;The problems in law enforcement are manifested in the unclear division of management among law enforcement departments and the simplification of regulatory bodies.The above problems have hindered China’s regulation of the phenomenon of online violence.The third chapter of this article proposes corresponding solutions and suggestions for the problems described in the second chapter.Firstly,in terms of legislation,China should strengthen legislative norms,specifically,introduce special legislation on cyber violence,improve the content system of laws and regulations,and strengthen the criminal law regulation of cyber violence;Secondly,in the field of justice,China should optimize the procedures for safeguarding rights and implement accountability for those who commit cyber violence,and further optimize judicial relief channels;Finally,in the area of law enforcement,a multi sector joint governance mechanism should be established,while strengthening self supervision and management of the network industry.I hope that the research in this article can improve the legal regulation of cyber violence in China.
