In terms of market supervision departments,administrative law enforcement serves as an essential means to fulfill their duties and carry out market supervision and management.For a long time,rigid law enforcement represented by administrative punishment and administrative compulsion has played an irreplaceable part in guaranteeing the smooth operation of market economy.With the deepening reform of the system and mechanism,B City has been ploughing deeply in the field of “loosening management,delegating regulation and deepening service” as the traditional law enforcement model is gradually unable to meet the new requirements of optimizing the business environment in the new era and needs further reform and optimization.By combing out the Regulations on the Optimization of the Business Environment and relevant documents of B City,this thesis expounds its new requirements for law enforcement in the field of market supervision,which mainly includes improving the law enforcement system and mechanism,enhancing the efficiency of law enforcement work,expanding the service space and intensity in law enforcement work,and handling cases in two key areas of intellectual property infringement and counterfeiting.In line with the above four requirements,the current setting and working status of market regulatory agencies are summarized,and the existing problems are figured out one by one,namely,complex institutional functions,lagging laws and regulations,lack of service awareness,hidden and complex development of cases in key areas,etc.As the analysis is shown,the reasons leading to the above problems are as follows: the inevitable impact of system and mechanism reform,the shortcomings of education and training,the difficulty of changing traditional law enforcement concepts,and the lack of effective coverage of assessment indicators.Combined with the problems and reasons for the appeal,the following suggestions are given to improve the comprehensive law enforcement work and help to optimize the business environment.First,we should promote the upgrade of law enforcement concept and improvement of the law enforcement capabilities,guide law enforcement personnel to change from industry managers to social organizers and public service providers,actively explore the best solution to serve the main market players and promote the ecological optimization of the industry,and be more result-oriented.Second,we should optimize and improve the system and mechanism,introduce specialized technical talents,improve the pattern of manpower allocation,and make staff mobilization and mutual support more convenient when handling major cases through coordinated and unified management.Third,we should establish the dynamic analysis mechanism for the demands of cadres;combine the actual demands,acceptance level,practical application effect,and other factors of cadres;and start from the fundamental demands of cadres and staffs,set appropriate education and training contents,and expand the space for growth.Fourth,we should improve the assessment and evaluation system of law enforcement agencies;introduce case quality,social effects,public evaluation,market environment,and other aspects into assessment contents;take case quality as the core;and introduce evaluation indicators from multiple perspectives. |
