Study On The Problems And Countermeasures Of The Legalization Of Community Governance In P District Of Shanghai

The construction of community governance under the rule of law is a concrete manifestation of the rule of law,and also a basic form of social governance in the new era.It is of great significance to the realization of socialist rule of law.The legalization of community governance runs through the spirit of legalization in the process of community governance at different levels,and promotes the legislation,law enforcement,justice and law-abiding of community governance with the rule of law.The realization of the legalization of community governance needs not only the guidance of the spirit of rule of law,but also a complete legal system of community governance.Therefore,China should constantly strengthen the construction of the legal system of community governance,while giving play to the role of soft laws such as autonomy regulations in community governance,forming the coordination between public law and soft law,and promoting the realization of the construction of community rule of law.Compared with other cities,the legalization of community governance in Shanghai is more forward-looking.With the promotion of the reform and construction of the rule of law in China,Shanghai,in combination with the development of the local market economy,took the lead in carrying out the pilot construction of the rule of law for community governance.After years of practical experience,it has made remarkable achievements,making Shanghai a model for other cities.Based on this,this paper chooses the legalization of community governance in Shanghai as the research object,dialyzes the practical experience of the legalization of community governance,analyzes the effectiveness and lessons of the legalization of community governance from the perspective of the legalization,further analyzes the deep-seated problems in the construction of the rule of law,and puts forward corresponding countermeasures and suggestions.This paper takes P District in Shanghai as an example to illustrate the development process and main contents of P District in the construction of community governance by law.First,combined with the background analysis of the legalization of community governance in District P,the main content is analyzed from the aspects of the subject of community governance,the main goal of the legalization construction,and the legalization reform of community governance.On this basis,summarize the achievements of the legalization of community governance in District P.In order to conduct research on the legalization of community governance,carry out empirical research on the construction of the legalization of community governance in Area P,deeply understand the current situation of the legalization of community governance in Area P,and point out that the application of legal systems is vague and conflicting,community governance is heavily administrated,residents have low awareness of participating in the legalization of community governance,rule of law culture and awareness are insufficient,and there is a lack of professional talents for the construction of the rule of law.At the same time,through in-depth analysis of the specific reasons,such as the imperfect rule of law system at the government level,the community level and the residents’ level,the deep-rooted traditional concept of community governance,the lack of awareness and ability of residents to participate in the construction of the community rule of law,the lack of awareness and ability to preach the rule of law in community governance,and the scarcity of professional talents in the rule of law in community governance.In order to effectively put forward the countermeasures and suggestions for the legalization of community governance in P District of Shanghai,this paper reviews and draws on the experience of the legalization of community governance in other domestic cities.It focuses on the analysis of the experience of the community governance legalization construction in Luohu District of Shenzhen,Haidian District of Beijing and Shangcheng District of Hangzhou,summarizes the experience of these three areas,and expounds the enlightenment of the community governance legalization construction in this paper.At the same time,combined with the basic situation of the legalization construction of community governance in P District of Shanghai,the paper puts forward some suggestions on how to establish and improve the community governance rule of law system,change the legal thinking and way of community governance,actively encourage residents to participate,cultivate the community rule of law culture,and strengthen talent construction.
