General Secretary Xi Jinping once pointed out that to "improve the rule of law in social governance","the focus of social governance must be implemented in urban and rural areas and communities".Combined with these two points,the construction of community governance by law is undoubtedly the key to promote the legalization of social governance.Communities belong to the grass-roots level,and community governance can learn from the excellent experience of China’s grass-roots level governance--"Fengqiao Experience".Its core is people-centered,resolving contradictions at the grass-roots level and solving contradictions on the spot,which is a banner of the comprehensive political and legal governance front of the country.What is the legalization of community governance? With the rule of law system as the starting point,the spirit of rule of law runs through the community governance at the ideological level,and the legislation,law enforcement and justice are combined at the practical level.Improve the laws and regulations of community governance at the static level,and apply,implement and supervise the laws and regulations of community governance at the dynamic level.What is more important is the rule of law of community governance,carefully considering the community grass-roots background,giving full play to the role of soft law such as autonomy statute,resolving community conflicts through the dispute mediation mechanism,and managing various community affairs.As China enters a new era,the society keeps developing,and the problems faced by community governance keep changing.The "Fengqiao Experience",in which the local elites of Singapore and China adhere to the "three-in-one" approach of rule of virtue,rule of law and autonomy to participate in grass-roots social governance,is a innovation of traditional grass-roots social governance experience.Community governance under the rule of law is a new practice of "Fengqiao experience" in the new era.Communities A,B,D and E in C City are the study samples.Each community has its own distinctive building theme,among which the theme of D community is "rule of law",so it is more perfect in the construction of rule of law than other communities.Community party-mass service center convenes community residents to carry out law popularization activities such as mock court to enhance community residents’ awareness of rule of law;The neighborhood committee and the residents jointly formulate an autonomous convention belonging to their own community to facilitate community management;The community set up a "law enforcement" volunteer team to punish the residents who violate the relevant provisions of community management;In the community to put in an integrated machine,easy to community residents to the Justice Bureau to submit assistance application......Other community because the theme of the building is different,the emphasis of the community construction is different also,and did not change because of community governance thinking deep logic is still the town government management and multiple governance body lack independence and autonomy ability,community governance under the rule of law theory basis and practice experience of the logic of card can be eligibility to deepen,policies and regulations on the implementation of the bias,In the construction of community governance under the rule of law,there are the following deficiencies: there is no autonomous regulation,and residents’ daily life lacks autonomous regulation constraints;The legal service mechanism is not sound,residents have difficulties in seeking help,and disputes and conflicts cannot be resolved locally;Community supervision mechanism is not perfect,supervision effect is not obvious.In order to improve the construction of community governance under the rule of law,the following optimization suggestions are put forward: First,the Party construction leads the construction of community governance under the rule of law.The party-mass service center publicizes the idea of rule of law,guides the community residents to formulate self-government conventions,and cultivates the community residents’ thinking of rule of law.At the same time,the party rules and regulations should be used to regulate the behavior of the party organizations or party members in the community.Second,we will introduce special laws on community governance and improve laws and regulations on community governance.Third,formulate the autonomy of the community statute,give play to the role of soft law.Fourthly,the legal service mechanism should be established and improved through the improvement of the legal service system and the establishment of a coordinated linkage mediation mechanism.Fifth,improve the community governance supervision mechanism,supervision will be implemented.Although the research on the communities A,B,D and E in C City is A case study,the above communities belong to the areas with rich and profound historical tradition in C City,with both old courtyards and merchants gathering there,which are representative and universal in the construction of big cities.Therefore,the empirical analysis using the above community samples is representative,and the improvement measures proposed in view of the deficiencies of the samples are universal for the construction of the rule of law in community governance in China.
