Research On Cumulative Rules Of Origin Of RCEP

On November 5,2020,China signed the regional comprehensive economic partnership(RCEP)with 10 ASEAN countries,Japan,South Korea,Australia and New Zealand,and the world’s largest free trade area was born.RCEP has a total of 20 chapters,covering trade in goods,rules of origin,trade in services and other contents,of which the rules of origin adopt regional cumulative rules.RCEP regional accumulation rules enable goods with origin qualification in the region to accumulate in all countries in the region.At the same time,RCEP stipulates the review of the complete accumulation rules within 5 years,that is,as long as production is carried out in the region,all value-added components can be accumulated,regardless of whether the intermediate products or raw materials used have the qualification of origin.RCEP cumulative rules of origin can promote regional integration and increase intra regional trade.The cumulative rules of origin of RCEP are not only reflected in the cumulative provisions.Because some countries adopt "country concessions" and apply different tariff commitment tables to different countries,the cumulative rules are also applied under differentiated tariff rates.At present,there is little special research on RCEP cumulative rules of origin.In view of the important role of RCEP cumulative rules of origin in enterprise production layout and promoting regional integration,it is necessary to analyze the terms,scope of application and application under differentiated tariffs of RCEP cumulative rules of origin.The comprehensive and progressive agreement for trans Pacific Partnership(CPTPP),the United States Mexico Canada agreement(USMCA)and the China and ASEAN Free Trade Area(CAFTA),which are the mainstream free trade agreements in the world,also stipulate the accumulation rules.Compare the RCEP accumulation rules with them,analyze their respective characteristics,advantages and what RCEP can learn from,so we can promote the implementation and improvement of RCEP accumulation rules.At present,China has formulated applicable measures for the rules of origin,but the legislation has no provisions on whether to use the rules of origin in special regulatory areas.At the same time,the operability of the provisions of the approved exporter system is not strong.In combination with the problems encountered in the implementation of RCEP,such as the low application rate and enterprises’ insufficient understanding of RCEP cumulative rules,the government should further refine the applicable provisions of RCEP rules of origin and strengthen the training on the cumulative rules of origin of RCEP for enterprises.Enterprises should also flexibly apply the cumulative rules of origin.At the same time,there are some ideas on how to connect the cumulative rules of RCEP with the "Hainan origin" system of Hainan Free Trade Port.
