On The Application Of Rules Of Origin And The Improvement Of The Rules Of Origin In China

Rules of Origin are one of the important rules of WTO and are named the economy nationality of goods. In world trade, the implementation of many trade measures all relate to the origin of goods, such as most-favored-nation clause, anti-dumping, discriminatory quantity limit and trade statistic and so on. At the same time, rules of origin also play an important role on most-favored trade arrangement (mainly functioned on trade union and GSP in developing countries). So WTO and the governments of countries all attach much attention on and establish Rules of Origin, adjusting and modifying it with the change of position and condition. Our country also modified the rules of origin in 2004.while comparing with Agreement on Rules of Origin and the rules of origin of other countries (or areas) and taking a look at its practical performance effect, the rules of origin of our country exists some limitations because of varieties of reason, so it can not satisfy the needs of protecting correlative industry and creating more developing space for external trade after entering WTO. In conclusion we should take a deeper research on rules of origin to maintain the economic rights and interests and improve our ability of grasping the challenging opportunity.There are five parts in the essay.In the first part of the essay, the writer gives a brief introduction about origin and rules of origin first, then the sort of rules of origin and criteria of determining origin of goods, as well as the influence of rules of origin on world trade.In the second part, the essay mainly introduces the formation and central contents of Agreement on Rules of Origin and analyzes its shortcomings.In the third part, the essay introduces the performance of rules of origin on main aspects of world trade, such as most-favored-nation clause, anti-dumping, discriminatory quantity limit and trade statistic and so on. This part is the main part of the essay.In the four part , comparing with the practice of other countries and areas onorigin of rules, the essay introduce the present situation of our country's origin system and its difference between Agreement on Rules of Origin, analyzes the problems of our country's rules of origin.In the last part, based on the analysis in the first four parts, the essay bring forward some advices to fully exert the important function of rules of origin, which is the main value of this essay.
