The report to the 20 th National Congress of the Communist Party of China pointed out that "we will continue to open up to the outside world at a high level,and accelerate the building of a new development pattern in which the domestic cycle is the main body and the domestic and international cycles are mutually reinforcing." China’s accession to and implementation of the RCEP is not only a reasonable choice for China’s economic development,but also an important measure to cope with the complex international environment.The formal signing of the RCEP on 15 November 2020 has transformed Asian countries from "passive recipients" to "leading players" in other high-level free trade agreements.Such role change is conducive to realizing the development of Asian countries’ own interests.At the same time,China and Japan reached a breakthrough in the RCEP trade arrangement for the first time,further boosting regional economic development.As the core of RCEP,the status of rules of origin is even more important.Since the US withdrew from the CPTPP in 2017,reached the US-Canada/Mexico Free Trade Agreement,and imposed tariffs on some Chinese goods through the origin of their products in violation of WTO rules in 2018,Chinese enterprises have paid more attention to the origin of their products.By elaborating the content of the rules of origin of RCEP and comparing the rules of origin of RCEP with those of WTO,EU,CPTPP and USMCA,this paper analyzes the differences of the rules of origin of RCEP with those of other international trade agreements and the reasons behind them.Through practical utility analysis of specific data and cases,In order to make full use of the RCEP Rules of Origin in order to maximize the benefit of China in international trade,this paper concludes the positive impact of the RCEP rules of Origin on trade tariff and economic development as well as the challenges put forward by our country,and puts forward some feasible countermeasures for the improvement of relevant laws systems of origin.First,it expounds the main content and characteristics of the RCEP rules of origin.The characteristics of RCEP are shown in the entity rules as the unique full production standard,the relatively loose RVC40 standard and the unique full accumulation rule.In the procedural rules,it is reflected in the moderately relaxed safeguard clauses-direct transport rules,the first proposed autonomous declaration of approved exporters and the back-to-back certificate of origin system.Secondly,through comparative analysis and research with WTO rules of origin,EU rules of origin,CPTPP rules of origin and USMCA rules of origin,it is concluded that RCEP rules of origin are a new set of rules.Compared with WTO rules of origin,RCEP has more detailed standards of origin and more practical procedures of origin.Compared with EU rules of origin,the standards of origin are relaxed and flexible,and the rules of regional accumulation are more concise.Compared with the CPTPP and USMCA rules of origin,it is flexible and less restrictive.For the first time,it adds the independent declaration of approved exporters and puts forward the concept of back-to-back certificates of origin.However,in terms of cumulative rules,The full accumulation rule of RCEP which cannot be realized immediately is relatively backward compared with the full accumulation rule of CPTPP and USMCA.Through these differences and analysis of production.By analyzing the differences and field of countervailing and anti-dumping.Meanwhile,RCEP Rules of Origin have brought some challenges to our country.The standard of Origin does not respond to special products by stratification,which results in unable to make full use of the rules of Origin to develop our economy.The management system of origin is in the passive management stage,which leads to the failure of our country to play a great role in protecting our industry rationally.The RCEP regional accumulation rule has led to the relocation of some Chinese industries.All these problems require China to take measures to deal with them.Finally,in view of the challenge posed by the rules of origin of RCEP,our country can put forward countermeasures on the legal level.The special products are divided into products with excess production capacity,products with government quota and high-tech products.The hierarchical standards of origin are formulated for these products,and the rules of origin are fully utilized to realize the rational allocation of resources.Transform the "passive management" mode of origin into "active management" mode,and give full play to the role of government in protecting the domestic industry;And raise the threshold of our cumulative rules moderately to protect our industry development.Through the above countermeasures to improve the relevant law system of origin,protect the domestic related industry chain development,to improve the modernization of economic system,build the new system of open economy at a higher level.
