A Study On The Legal Regulation Of Food Waste

Survival is the most basic need of human beings,and the lack of food will hinder human survival and development,so that human beings face a huge existential crisis.At present,the problem of food waste in China is very serious,producers and sellers take profit as the first purpose,consumers lack of awareness of saving,resulting in food waste in all aspects of the food supply chain are very prominent,such as the recording process of the variety show "Youth with You 3" during the recording process of fans to give idols a large number of dumping fresh milk,Yangzhou to obtain the Guinness Record to make the largest egg fried rice results but waste cases,etc.,these are the tip of the iceberg of food waste.Food waste will bring serious consequences,China’s "Fourteenth Five-Year Plan" clearly states that China can meet the food self-sufficiency,but also almost just reached self-sufficiency,and can not have a large surplus,a large amount of food waste will seriously endanger the country’s food security,and reduce food waste,can to a certain extent to ensure the country’s food security,is conducive to maintaining the country’s food security strategy.In addition,the waste of food is not conducive to the protection of the ecology,which is equivalent to the indirect waste of water resources,land resources,etc.,which affects the ecological environment to a certain extent.Therefore,it is imperative to reduce food waste.On April 21,2021,China promulgated the "Anti-Food Waste Law",since then China has a special law to regulate food waste,but the law is still insufficient,its mandatory provisions are less,mostly principled,advocacy provisions,weak operability,from the practical point of view,the effect of law implementation is not good,can not achieve the results of reducing waste.Therefore,it is necessary to continue to build a complete legal system,in view of the different characteristics of the production,sales and consumption links,targeted policies,such as the characteristics of the large amount of waste in the production and sales links,the concentration of waste behavior,more mandatory provisions in the "Anti-Food Waste Law",and even the "Criminal Law" to constrain,for the consumption link of its wide range,small amount of personal waste and other characteristics,more with soft law constraints.In the field of food waste,specific analysis of specific problems in different links,the formulation of clear standards,soft and hard methods at the same time,in order to better curb food waste behavior,better maintain China’s food security,and maintain China’s ecological environment.
