Problems And Improvement Of Food Recall System In China

Food safety has been the focus of people’s attention since ancient times.In order to protect the public’s life and health,China has promulgated the "food hygiene law","food safety law" and other laws as an important legal basis to crack down on unsafe food.However,large and small food safety incidents often occur in various places,in order to ensure the safety of commercially available food and enhance public awareness of food safety China has established a food recall system based on the trust of food supervision.Food recall system is different from other laws and regulations in the food field.It is a kind of preventive relief means in advance.The development of recall work does not take the occurrence of actual damage as the premise,so it can be recalled before the unsafe food has caused harm.Food recall system is of great significance to the inspection and supervision of food safety.It is a safety line to protect the public from unsafe food.Western countries established the food recall system as early as the 1980 s,but China’s food recall system has only been established for more than ten years.Due to the late establishment and insufficient development,there are still some problems: from the perspective of system provisions,one is the unclear definition of the recall object,which brings burden to the judicial work in practice;the other is the lack of recall performance Third,the supporting mechanism based on traceability system is not perfect,so it is difficult to determine the specific link of food risk,which increases the difficulty of recall.From the perspective of actual operation,on the one hand,the market supervision department’s participation in the process of unsafe food recall is not deep enough,and the supervision is not in place,which fails to play a good role in supervision;on the other hand,the starting mechanism of recall suffers great resistance in practice,which makes the development of recall more difficult.In order to solve the above problems,this paper puts forward suggestions from three aspects.Firstly,in terms of legal provisions,the definition of unsafe food in the food recall system should be made clear;secondly,in terms of the start-up mechanism,the first is to urge producers and operators to take the initiative to recall;the second is to expand the main body of the recall to make the food recall system operate better;finally,in terms of the implementation mechanism,improving the information mechanism and strengthening market supervision can ensure the safety of food The food recall work goes on smoothly.
