| With economic development,the number of disputes has been increasing.The Communist Party of China(CPC)and the country have issued several documents emphasizing "prevention and control at the source,diversified solutions to disputes" and "mediation before litigation".In order to implement the plan of the CPC Central Committee,the Supreme People’s Court proposed to fully mobilize social forces,deepen the source of litigation governance,and build a "one-stop diversified dispute resolution",and reported many times at the National Two Sessions that this featured dispute resolution mechanism played an important role in social governance.In this paper,"one-stop diversified dispute resolution" is regarded as a social action system,and its social governance functions are summarized as social dispute resolution,public service achievement,social resources integration and social and cultural maintenance by means of Parsons AGIL functional model.Social dispute resolution is a basic function,reflecting in adapting to the environment of external contradictions,coordinating internal and external resources and resolving conflicts and disputes by non-litigation and litigation.Public service achievement is a significant function,among which "lawsuit source prevention","lawsuit non-connection" and "intelligent convenience" form a dispute resolution system to serve the public.Social resource integration is a fundamental function that helps people to resolve disputes quickly and online by introducing experts,organizations and information technology.Social and cultural maintenance is the guarantee function,which includes the cultural maintenance of members and the recognition of the concept of the public so that the concept of dispute resolution can be deeply rooted in people and promote social stability and development.At present,the social governance function of "one-stop diversified dispute resolution" still has many problems,which are attributed to the constraints of the relevant environment,own conditions,external integration,cultural communication and other factors.It is necessary to constantly improve the four functions to influence each other and work together,so as to maximize the best effect of social governance.It is expected that the above research results can provide enlightenment for China’s "one-stop diversified dispute resolution" to better play its social governance function,and play a certain reference role for the political and legal departments to further improve relevant policies and systems. |
