Application Of Diversified Dispute Resolution Mechanism In Social Governance

With the rapid development of China's economy and the increasing improvement of people's living standards,people's economic life exchanges are becoming more and more frequent.At the same time,the pattern of interests is also constantly adjusted,under the influence of multiple factors,leading to prominent social contradictions,disputes continue to occur.Under the background of economic development and rule by law,people's legal consciousness is constantly improving.The parties to a dispute tend to settle disputes through litigation mechanism,so the number of cases accepted by the courts is increasing year by year.The influx of a large number of cases into the courts is not conducive to the timely settlement of disputes by the courts,but may further intensify contradictions.Therefore,we should better play the important role of diversified dispute resolution mechanisms in solving social disputes.As an integral part of social governance,diversified dispute resolution mechanism is of great significance in promoting the modernization of national governance system and governance capacity.The research methods of this paper include literature research,case analysis and field investigation.In this paper,the application of diversified dispute resolution mechanism in grass-roots social governance is analyzed by taking the 12 th Company of 64 Regiments as an example.For example,mediation,arbitration,reconciliation and petition system play a very important role in solving social disputes quickly,maintaining social stability and rapid economic development.This paper consists of four chapters.The introduction part mainly introduces the research reasons and significance of the paper,and expounds the research trend and progress of the diversified dispute resolution mechanism in the United States,Germany and Japan,the survey site and the research methods used in the paper.The first chapter mainly introduces the concept,content and development process of the diversified dispute resolution mechanism in detail,which will provide theoretical basis for the following case analysis.The second chapter elaborates the content of our diversified dispute settlement mechanism,focusing on the conciliation mechanism,arbitration mechanism and conciliation mechanism in detail.Chapter three analyses the working process of the People's Mediation Committee of the 12 th Company of 64 Regiments through the form of mediation cases,and the application of mediation mechanism in the dispute settlement of the 12 th Company of 64 Regiments.Chapter four analyses the actual application of the petition system in the 12 th Company of 64 Regiments.The conclusion puts forward Suggestions on the connection between litigation dispute resolution mechanism and non-litigation dispute resolution mechanism,as well as the need for the country to incorporate diversified dispute resolution mechanism procedures into the legislative agenda,so as to provide a legal basis for non-litigation dispute resolution mechanism.
