Research On Legal Risk Management And Countermeasures In The Whole Process Of EPC Project Management

With the rapid development of construction industry,a more efficient construction project management mode is needed.More and more fierce competition in the market makes it difficult for the traditional contracting mode to fit with the mainstream trend of future society.Therefore,the general contracting mode has ushered in a new development peak period under the environment of our country,and has also gained strong push by all government forces.But in our country at the present stage to improve laws and regulations further and improve the administrative supervision requirements,the general contracting project faces the risk,also along with the construction enterprise scale which has been expanding in our country and the fierce market competition becoming worse day by day,among which the legal risk is particularly outstanding.Therefore,from the perspective of legal risks,this paper will discuss the risks related to the operation of EPC general contract projects,improve their management level and promote their development.Specific analysis is as follows:First,the whole process of EPC general contract project legal risk identification.First of all,according to the relevant literature,the literature check method is adopted to preliminarily list and summarize the risk points mentioned in the research on the whole process of the current domestic EPC general contract project legal risk.The legal risk points are sorted out and classified according to the design stage,the bidding stage,the contract signing stage,the contract performance stage and the contract settlement stage.And compile a list of risk factors;Secondly,the Delphi method is used to conduct questionnaire survey and analysis,and finally determine the 20 key factor table,so as to establish the key factor table.Second,the legal risk analysis of EPC general contract project based on structural equation model.Through the identification results of risk factors,the structural equation model is established to analyze the legal risk factor points of the identified EPC general contracting projects.The construction of structural equation model should be based on the important factors affecting the legal risk of EPC general contracting projects and the influence relationship between the influencing factors and the form of expression.Third,the whole process of EPC general contract project legal risk management countermeasures.According to the legal risk factors identified and the analysis conclusions of structural equation model,from the key risk factors,through literature research and case analysis and other methods to put forward constructive management countermeasures and basis to reduce the risk.In summary,based on the contract theory,whole life cycle theory,risk management theory,this paper uses the methods of text analysis,literature selection method,structural equation model,Delphi method and case analysis,discusses the legal risk prevention measures of EPC project construction contract,and then provides referential experience for our construction industry faced with legal risk recognition and processing.
